CITY OF SEWARD, ALASKA
RESOLUTION NO. 2002- 004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH TRANSP AC MARINAS, INCORPORATED FOR THE
PURCHASE OF 100 SAFETY LADDERS FOR AN AMOUNT NOT TO
EXCEED $18,800.
WHEREAS, a large portion of the harbor float system was replaced during the recent
renovation project and to save on installation and project costs, several items were left f@r future
additions and/or projects; and
WHEREAS, one ofthese critical issues is the procurement and installation of safety ladders
required by the Occupational Safety and Health Administration regulations for worker safety; and
WHEREAS, these ladders are also necessary for the safety of customers in the harbor; and
WHEREAS, the harbor staff researched many types ofladders constructed of many types of
materials and contacted several vendors, manufacturers and sources of ladders; and
WHEREAS, Transpac Marinas, Incorporated offered to take a look at the issue and designed
a galvanized steel ladder, incorporating the existing bolt holes and design ofthe float system into the
concept; and
WHEREAS, a prototype was ordered, installed and tested and found to be of superior
quality, function and design; and
WHEREAS, per City of Seward Code of Ordinances S6.1 0.120, this purchase is exempt
from competitive procurement procedures for two reasons; it is a proprietary design of one company
and is therefore manufactured by only one source, and it is a patented item.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TH~ CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into an agreement with Transpac
Marinas, Incorporated for the purchase of 100 safety ladders for an amount not to exceed
$18,800.
Section 2. This purchase is exempt from competitive procurement procedures
because the item is a patented design and available only from one vendor.

Section 3. This resolution shall take effect immediately upon adoption.
