RESOLUTION 2002-011
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING FOR DISPOSAL BY NEGOTIATED SALE, LOT
2, BLOCK 1, FOURTH OF JULY CREEK SUBDMSION, SEWARD
MARINE INDUSTRIAL CENTER FOR NO LESS THAN APPRAISED FAIR
MARKET VALUE, AND AUTHORIZING NEGOTIATION OF AN
ASSOCIATED EASEMENT
WHEREAS, Shoreside Petroleum, Inc. submitted a request to purchase Lot 2, Block 1,
Fourth of July Creek Subdivision, Seward Marine Industrial Center from the City of Seward; and
WHEREAS, the requested parcel is located east of Nash Road at 3306 Jellison Avenue, and
is zoned Industrial; and
WHEREAS, Shoreside Petroleum, Inc. has leased the property since 1988, and have
developed the site with a bulk fuel plant; and
WHEREAS, Shoreside Petroleum, Inc. has also requested a utility easement to cover the
existing underground fuel pipeline that runs from their lease parcel to the North Dock, and is located
within the Jellison Avenue and Nash Road dedicated right-of-ways, and city-owned Tract A, Fourth
of July Creek Subdivision, Seward Marine Industrial Center; and
WHEREAS, pursuant to Seward City Code ~ 7.05.120, the City Council may dispose of real
property by negotiation, public auction or sealed bid; and
WHEREAS, City Code 7.05.115 considers an easement to be a form of disposition of an
interest in public property, and the City Council must approve easements that have over 20 year
terms; and
WHEREAS, the Planning and Zoning Commission approved Resolution 2002-04
recommending that City Council authorize the disposal of the requested property to Shoreside
Petroleum, Inc. for no less than the 2000 appraised value of $22,496, and further recommended that
Council grant the pipeline easement for no less than the appraised fair market value as required by
City Code 7.05.150.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The Seward Marine Industrial Center (SMIC) has been identified and marketed as
available for disposal by long term lease. The City Council finds it in the public interest to dispose of

Lot 2, Block 1, Fourth of July Creek Subdivision, SMIC, by sale through sole source negotiations
with Shoreside Petroleum, Inc. in an effort to stimulate economic activity in the Seward Marine
Industrial Center. The sale shall be for no less than the appraised fair market value, subject to terms
and conditions to be negotiated and brought before the City Council for further consideration and
final approval.
Section 2. The City Manager is authorized and directed to negotiate a real estate purchase
and sale agreement with Shoreside Petroleum, Inc. to be brought back to the City Council for further
consideration and final approval.
Section 3. The City Council further finds that it is in the public interest to negotiate pipeline
easement(s) to Shoreside Petroleum, Inc. for no less than the appraised fair market value of the
easement(s), and authorizes the City Manager to negotiate and prepare the requested pipeline
easements to be brought back to the City Council for further consideration and final approval.
Section 4. It is not intended that this resolution approve the proposed described real estate
transactions but is to authorize the negotiation of such a purchase and sale agreement and easements
subject to Council final approval. Any subsequent resolution actually approving the real estate
transactions shall not take effect until 30 days after passage and posting as required by Seward City
Code ~ 7.05.140.
Section 5. This resolution shall take effect immediately.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 28th day
ofJanuary, 2001.
