RESOLUTION 2002-014
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE
ACQUISITION OF U.S.S. 1931, APPROXIMATELY 30 ACRES OF
PROPERTY GENERALLY LOCATED BEHIND TWO LAKES PARK ON
MARATHON MOUNTAIN, FOR CITY PARK PURPOSES
WHEREAS, Ken Allen, on behalf of his adult children, has requested that the City consider
acquiring US.S. 1931; and
WHEREAS, US.S. 1931 is a29.16 acre unimproved parcel that is generally located west of
Two Lakes Park on the side of Marathon Mountain; and
WHEREAS, US.S. 1931 is zoned Rural Residential, and the Land Use Plan designation is
Resource Management due to inadequate information on the extension of public services and
utilities, the suitability of the land to support development, and environmental considerations; and
WHEREAS, the Parks and Recreation Master Plan and the Municipal Lands Management
Plan both recommend city acquisition ofthis property to preserve the trail and emergency evacuation
route and mountain side backdrop and watershed; and
WHEREAS, a goal of the Strategic Plan is to preserve and protect the scenic views of the
mountains and Resurrection Bay by seeking ways to protect the watershed and mitigate development
impacts on the slopes of Bear Mountain, Marathon Mountain, Mt. Benson and the Mt. Alice Bench;
and
WHEREAS, the Planning and Zoning Commission held a public hearing on this request and
recommended that the city proceed to acquire the property, and
WHEREAS, the Commission further recommended that the city examine grant funds, funds
from previous sales of city land, trade of comparable city land, and inclusion on the federal priority
list as possible sources of funding for purchasing the property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council finds that it is in the public interest to acquire US.S. 1931 for
city park, watershed and emergency evacuation route purposes. The City Manager is authorized and
directed to negotiate the acquisition ofthe property which may include obtaining a current appraisal,
identifying potential funds, and negotiating a purchase and sale agreement subject to terms and
conditions to be brought back to the City Council for final consideration and approval.
Section 2. It is not intended that this resolution approve the proposed described real estate
transaction but is to authorize the negotiation of such a purchase and sale agreement. Any
subsequent resolution actually approving the real estate transaction shall not take effect until 30 days
after passage and posting as required by Seward City Code 7.05.140.

Section 3. This resolution shall take effect immediately.
