RESOLUTION 2002-025
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING FOR DISPOSAL BY LEASE, AN INTEREST IN
CITY-OWNED LOTS llA AND 12A, FORT RAYMOND SUBDIVISION
REPLAT NO.1, BY SOLE SOURCE NEGOTIATION WITH THE
DEPARTMENT OF ARMY, FOR A THREE YEAR TERM FOR THE
PURPOSE OF STUDYING THE POTENTIAL DEVELOPMENT OF A
JOINT PUBLIC-PRIVATE VENTURE FORA RECREATIONAL ACTIVITY
CENTER
WHEREAS, the Department of Army (DOA) has requested that the City enter into a three
year lease of city-owned property for the purpose of studying the potential development of a joint
public-private venture for a recreational activity center that would include a bowling alley and
concession; and
WHEREAS, the requested property is approximately five acres of city-owned land identified
as the southemportion of Lots llA and 12A, Fort Raymond Subdivision Replat No. 1. Theproperty
is located north of Sea Lion Drive between Dimond Boulevard and the Seward Highway and is
currently zoned Park and Institutional; and
WHEREAS, the City Council at its regular meeting held on January 22,2001 approved
Resolution No. 2001-018 supporting the concept of the Seward Resort's proposed recreational
activity center; and
WHEREAS, the City has not previously identified this parcel as available for disposal; and
WHEREAS, at its regular meeting of February 25,2002 the City Council requested that the
Planning and Zoning Commission review and provide a recommendation regarding the pros and
cons of disposing of an interest in the property to the Department of Army to lease approximately
five acres ofland for a three year period for the purpose of studying the potential development of a
joint public-private venture; and
WHEREAS, the Commission at its regular meeting of March 5, 2002 recommended that the
City Council identify the approximately five acre portion of Lots llA and 12A, Fort Raymond
Subdivision Replat No.1 requested by the DOA as available for disposal by lease to the DOA for a
three year term for the purpose of studying the potential development of a joint public-private
venture for a recreational activity center; and
WHEREAS, the Commission further recommended that the City Council require that the
proposed three year lease allow the existing public uses on the property to continue during the term
ofthe proposed lease and the Commission also noted that any possible future long term lease would

require further review by the Commission in order to address subdivision and zoning issues as the
current designation ofthe property would not allow a recreational facility; and
WHEREAS, the City Council held a public hearing on March 25,2002 to determine if it is
in the public's interest to dispose of the nominated land and that the disposal is to be by sole source
negotiation with the DOA in order to study the potential development of a joint public-private
venture for a recreational activity center.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The above recital's are incorporated herein by reference. The Council finds that it
is in the public interest to make available for lease, the requested property to the Department of
Army in order to study the potential development of a public-private venture for a recreational
activity center because if the study results in a favorable determination of project success, it could
result in the following community benefits: construction of a needed community recreational facility
that shall be open to the general public, possible construction of the facility by a local firm,
additional jobs for local residents and increased tax revenue to the City.
Section 2. The Council authorizes for disposal by lease, an interest in a portion of city-
owned Lots llA and 12A, Fort Raymond Subdivision Replat No.1, by sole source negotiation with
the Department of Army, for a three year term for the purpose of studying the potential development
of a joint public-private venture for a recreational activity center and hereby authorizes the city
manager to negotiate a lease that will later be presented for public hearing and final approval by the
Council.
Section 3. Any possible future request for a long term lease to actually develop the property
with a recreational activity center would be subject to further review by the Planning and Zoning
Commission in order to address the subdivision and zoning issues. Lots llA and 12A, Fort
Raymond Subdivision would have to be subdivided and the property's land use plan and zoning
designation would have to be amended to a designation that allows a recreational facility.
Section 4. The proposed three year lease be subject to city attorney review.
Section 5. Any long term City lease require that all activities on site be subject to sales tax to
the extent permitted by law.
Section 6. The existing public uses continue during the term ofthe proposed lease and that
the developer work with the City to find a new place for these activities. During the term of the
property lease there will be no physical changes to the property other than survey markers.
Section 7. This resolution shall take effect immediately upon its adoption.
