HomeMy WebLinkAboutRes2002-053 I I I FAILED Sponsored by: Planning and Zoning CITY OF SEWARD, ALASKA RESOLUTION 2002-053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING FOR DISPOSAL BY LEASE AN INTEREST IN A PORTION OF CITY-OWNED LOT 1, BLOCK 6, SEWARD SMALL BOAT HARBOR SUBDIVISION THROUGH SOLE SOURCE NEGOTIATION WITH THE LESSEE OF THE ADJOINING ALASKA RAILROAD CORPORATION LEASE CONTRACT 6725 WHEREAS, James T. Pruitt has submitted a proposal to acquire through lease, sale or trade in exchange for public restrooms, city-owned Lot 1, Block 6, Seward Small Boat Harbor Subdivision; and WHEREAS, Mr. Pruitt has requested a portion (approximately 3,200 square feet) of the described property in order to provide access, on-site parking and landscaping for a proposed hotel development on adjoining Alaska Railroad Right-of-Way lease property; and WHEREAS, Lot 1, Block 6, Seward Small Boat Harbor Subdivision is a 13,632 square foot, triangular shaped, strip ofland located between Fourth Avenue and the Alaska Railroad Right-of- Way in the Harbor Commercial District; and WHEREAS, the City has not previously identified this parcel as available for disposal; and WHEREAS, the property is currently used for public parking, fire and pedestrian access lanes, utility easements, and access to Alaska Railroad Right-of- W ay lease property which includes the following: Sailing Inc, The Charter Option, Chinook's Restaurant, J-Dock Fish Company, William H. Seward Yacht Club, and Alaska Railroad Corporation Lease Contract 6725; and WHEREAS, the development potential ofthis lot is severely restricted by its size and shape, numerous utility easements, required fire lanes, and access routes to the Alaska Railroad Corporation lease parcels; and WHEREAS, at its regular meeting of February 25,2002 the City Council requested that the Planning and Zoning Commission review and provide a recommendation regarding the pros and cons of disposing of Lot 1, Block 6, Seward Small Boat Harbor Subdivision, in whole or in part, using the public request for proposals process; and WHEREAS, the Planning and Zoning Commission, at its regular meeting of March 5, 2002 determined that due to the limited size, shape, existing utility easements, required fire and pedestrian routes, and access issues for Alaska Railroad Corporation lease property associated with Lot 1, Block CITY OF SEWARD, ALASKA RESOLUTION 2002-053 6, Seward Small Boat Harbor Subdivision, it would not be appropriate to issue a request for proposals for the property. The Commission further determined that the public benefit was well demonstrated by disposing the requested :1:3,200 square foot portion of Lot 1, Block 6, Seward Small Boat Harbor Subdivision in association with the development of the adjacent Alaska Railroad Corporation Lease Contract 6725. WHEREAS, the Commission approved Resolution 2002-12, recommending that the City Council authorize the disposal by lease ofthat portion of Lot 1, Block 6, Seward Small Boat Harbor Subdivision located north ofthe 25 foot utility easement and J-Dock fire and pedestrian access lane through sole source negotiation with the lessee ofthe adjoining Alaska Railroad Corporation Lease Contract 6725, and subject to the lessee subdividing the property; and WHEREAS, the Commission further recommended that the City Council not dispose ofthe remainder of Lot 1, Block 6, Seward Small Boat Harbor Subdivision including the 25 foot utility easement and the portion south of the 25 foot utility easement in order to maintain the property for public parking, fire and pedestrian routes, utility easements and access to Alaska Railroad Right-of- Way; and WHEREAS, the City Council held a public hearing on May 28,2002 to determine ifit was in the public interest to dispose of the nominated land, and that the disposal was to be by sole source negotiation with the lessee of the adjoining Alaska Railroad Corporation Lease Contract 6725. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The above recitals are incorporated herein by reference. The Council finds that it is in the public interest to make available for lease the requested property to James Pruitt in order to provide access, on-site parking and landscaping for a proposed hotel development on the adjoining Alaska Railroad lease property, as described in the Alaska Railroad Lease Contract 6725. , Section 2. The Council authorizes for disposal by lease at fair market rental value, an interest in that portion of city-owned Lot 1, Block 6, Seward Small Boat Harbor Subdivision located north of the 25 foot utility easement and J -Dock fire and pedestrian lane, consisting of approximately :1:3200 square feet, by sole source negotiation with James Pruitt in order to provide access, on-site parking and landscaping for the associated development of adjoining Alaska Railroad lease property, and hereby authorizes the city manager to negotiate a lease that will later be presented for public hearing and approval by the City Council. Section 3. This resolution shall take effect immediately upon its adoption.
