HomeMy WebLinkAboutOrd1997-009 I I I Sponsored by: Garzini Introduction Date: March 10.1997 Public Hearing Date: March 24 1997 CITY OF SEWARD, ALASKA ORDINANCE NO. 97-09 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE SALE OF TAX-FORECLOSED PROPERTY DESCRIBED AS LOTS 36 AND 37, BLOCK 17, ORIGINAL TOWNSITE OF SEWARD WHEREAS, based on the Kenai Peninsula Borough 1985 tax foreclosure of 1984 Real Property Tax Liens, Case No. 3KN-85-500 CIV, and pursuant to AS 29.45.450, the following real property was deeded to the City of Seward by a Clerk's Deed dated the 19th day of July 1988 and recorded on the 14th day of September 1988 in Book 52, Page 119, records of the Seward Recording District, Third Judicial District, State of Alaska, relating to the following real property: Lots Thirty-six (36) and Thirty-seven (37), Block Seventeen (17), ORIGINAL TOWNSITE OF SEWARD, according to the official plat thereof, records of the Seward Recording District, Third Judicial District, State of Alaska; and WHEREAS, the real property is located at 330 Fifth Avenue, including Lots 36 and 37 of Block 17 as described above; and WHEREAS, the name of the last Record Owner of the real property appearing on the assessment rolls is Frances Kerns who was also the named owner at the time of the tax foreclosure; and WHEREAS, Frances Kerns is now deceased; and WHEREAS, court records indicate that the above real property passed by order of intestacy to William G. Kibsgaard and Raymond R. Kibsgaard, as tenants in common; and WHEREAS, notice of the City of Seward's intent to sell the real property was mailed to the heirs of Frances Kerns, namely Raymond R. Kibsgaard and William G. Kibsgaard, at their last known addresses; and WHEREAS, the City of Seward has no public purpose for the real property, declares the real property to be surplus, and finds that it should be sold to cover all taxes, penalties, interest, administrative costs, demolition costs and attorneys' fees; and WHEREAS, the City of Seward intends to offer the real property for sale; and WHEREAS, upon adoption of this ordinance determining to sell the real property and the sale or entry into a contract for sale of the property, the right of the former record owner and assigns to repurchase the real property ceases; CITY OF SEWARD, ALASKA ORDINANCE NO. 97-09 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. The City of Seward hereby declares that it has no public purpose for the below- described real property, declares that the Property is surplus, and declares that the real property shall be offered for public sale in the manner provided by law. Lots Thirty-six (36) and Thirty-seven (37), Block Seventeen (17), ORIGINAL TOWNSITE OF SEWARD, according to the official plat thereof, records of the Seward Recording District, Third Judicial District, State of Alaska; Section 2. The above real property shall be sold and the proceeds of the sale used to pay taxes, penalties, interests, administrative costs, demolition costs and attorneys' fees. Section 3. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 24th day of March, 1997.
