Sponsored by: Garzini Introduction Date: March 24. 1997 Public Hearing Date: April 14 1997 CITY OF SEWARD, ALASKA ORDINANCE NO. 97-10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AUTHORIZING THE SALE OF TAX-FORECLOSED PROPERTY DESCRIBED AS LOTS 17 AND 18, BLOCK 22, ORIGINAL TOWNSITE OF SEWARD WHEREAS, based on the Kenai Peninsula Borough 1991 tax foreclosure of 1990 Real Property Tax Liens, Case No. 3KN-91-105 CI, and pursuant to AS 29.45.450, the following real property was deeded to the City of Seward by a Clerk's Deed dated the 8th day of November 1993 and recorded on the 2nd day of December 1993 in Book 70, Page 474, records of the Seward Recording District, Third Judicial District, State of Alaska, relating to the following real property: Lots Seventeen (17) and Eighteen (18), Block Twenty-Two (22), ORIGINAL TOWNSITE OF SEWARD, ALASKA, according to Plat S-l, located in the Seward Recording District, Third Judicial District, State of Alaska (Tax Assessor No. 148- 150-03-0); and WHEREAS, the real property is located at 407 Sixth Avenue, including Lots 17 and 18, Block 22, as described above; and WHEREAS, the names of the last Record Owners of the real property appearing on the assessment rolls are Daniel F. and Patricia Wheeler who were also the named owners at the time of the tax foreclosure; and WHEREAS, Daniel F. Wheeler and Patricia Wheeler are both deceased; and WHEREAS, notice of the City of Seward's intent to sell the real property was mailed on March 11, 1997 to the heirs of Daniel F. and Patricia Wheeler, namely Alice Shea, Daniel Wheeler Jr. and Vera Corcoran, at their last known addresses; and WHEREAS, the City of Seward has no public purpose for the real property; declares the real property to be surplus; and finds that it is in the public interest to sell the property to cover all taxes, penalties, interest, administrative costs, demolition costs and attorneys' fees; and WHEREAS, the City of Seward intends to offer the real property for sale; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: CITY OF SEWARD, ALASKA ORDINANCE NO. 97-10 Section 1. The City of Seward hereby declares that it has no public purpose for the below described real property, declares that the Property is surplus, and declares that the real property shall be offered for public sale in the manner provided by law: Lots Seventeen (17) and Eighteen (18), Block Twenty-Two (22), ORIGINAL TOWNSITE OF SEWARD, ALASKA, according to Plat S-l, located in the Seward Recording District, Third Judicial District, State of Alaska (Tax Assessor No. 148- 150-03-0). Section 2. The above real property shall be sold and the proceeds of the sale used to pay taxes, penalties, interests, administrative costs, demolition costs and attorneys' fees. Section 3. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 14th day of April, 1997.
