RESOLUTION 99-044
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO INCREASE THE
PURCHASE ORDER TO ASHBURN & MASON FROM $5,000 TO $14,000
TO COVER PROFESSIONAL LEGAL SERVICES RELATED TO APUC
DOCKET U-98-70 (CITY OF SEWARD/CHUGACH ELECTRIC
ASSOCIATION WHOLESALE POWER SALES CONTRACT)
WHEREAS, the City of Seward and Chugach Electric Association have entered into a
signed wholesale power sales agreement; and
WHEREAS, the Alaska Public Utilities Commission (APUC) has approved this contract on
an interim basis effective September 1, 1998 pending hearing; and
WHEREAS, two of the Railbelt Utilities (MEA and ML&P) have objected to the contract
for various reasons requiring a public hearing before the APUC; and
WHEREAS, a hearing before the APUC requires the services of an experienced lawyer to
properly present the facts to the commission and cross-examine witnesses as necessary; and
WHEREAS, the City engaged the services of Ashburn & Mason after our regular City
Attorney was declared to have a conflict of interest; and
WHEREAS, the original estimate of $5,000 has grown to around $14,0000 for these
professional services;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager has approval to issue a purchase order and pay all billings up
to $14,000 from Ashburn & Mason in regard to this Alaska Public Utility Hearing.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council ofthe city of Seward, Alaska, this 26 day
of April, 1999.
