RESOLUTION 99-124
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, DETERMINING THAT IT IS IN THE PUBLIC'S INTEREST TO
WAIVE THE NORMAL BID PROCESS PER CITY CODE ~6.10.130 AND
AUTHORIZE THE CITY MANAGER TO ENTER INTO LEASE AGREE-
MENTS WITH XEROX FOR THE PURPOSE OF LEASING THREE
COPIERS
WHEREAS, the Xerox Lease Agreement for the Xerox 5100 copier (the large copier in the
City Hall basement) will expire in February, 2000; and
WHEREAS, the City's experience with heavily used copiers is that the older the copier gets,
the more maintenance problems there are, and the more downtime and delays that are experienced
by the City; and
WHEREAS, Xerox has approached the City about trading in the 5100 for a similar copier
with upgrades for newer technology; and
WHEREAS, Xerox has also made a proposal to replace two other smaller copiers located
in the City Hall mail room and the police department with newer copiers, with improved technology,
and at a lower cost; and
WHEREAS, the copier upgrades would replace older copiers with new copiers with
improved technology and an overall budget savings; and
WHEREAS, funding for the copiers is included in the respective department's current six
month budgets ending December 31, 1999 and will be included in future budgets for Council
approval; and
WHEREAS, the leases are for sixty (60) months and include the required non-appropriation
clause which allows the City to terminate the lease if monies are not appropriated for any given
budget year; and
WHEREAS, it is in the public interest to waive the normal bidding process per City Code
S6.1 0.130 based on the following: 1) the current copiers have a higher trade~in value with Xerox;
2) Xerox removes the current copiers at no extra cost; and 3) the maintenance level is excellent from
Xerox due to their Kenai Peninsula presence and the over whelming number of Xerox copiers in
Seward: . ."

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. It determines that it is in the public's interest to waive the normal bid process per
City Code ~6.10.130 and authorize the City Manager to enter into lease agreements with Xerox for
the purpose of leasing three copiers: a Xerox 5800 for the City Hall basement copier at a monthly
lease cost of $2,042.93; a Xerox DC332 for the City Hall mail room copier at a monthly lease cost
of$339.44 and a Xerox DC332 for the police department copier at a monthly lease cost of$368.41.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 13 day
of September, 1999.
