RESOLUTION 2001-042
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, SUPPORTING SENATE BILL 142 GIVING NOTICE AND
APPROVING A LEASE-PURCHASE AGREEMENT WITH THE CITY OF
SEWARD FOR THE CONSTRUCTION OF AN ADDITION TO THE SPRING
CREEK CORRECTIONAL CENTER
WHEREAS, the state and the commissioner of corrections have certain constitutional and
statutory duties to attempt to reform and rehabilitate prisoners and to provide educational and other
opportunities to improve the opportunity for the eventual successful reintegration of those prisoners
into society; and
WHEREAS, Senate Bill 142 provides for educational opportunities for prisoners committed
to the custody of the commissioner of corrections and especially to provide those opportunities to
prisoners of school age through the pilot program that has been implemented at Spring Creek
Correctional Center; and
WHEREAS, Senate Bill 142 provides for the construction of a correctional facility and to
provide secure classroom facilities and housing for prisoners transferred to Spring Creek Correctional
Facility to use those facilities, the Department of Administration, on behalf of the Department of
Corrections, may enter into a lease-purchase agreement with the City of Seward for the construction
of an addition to the Spring Creek Correctional Center; and
WHEREAS, Senate Bill 142 approves the total construction and related costs ofthe addition
to the correctional facility may not exceed $24,000,000; and
WHEREAS, Senate Bill 142 approves the total lease payments for the full term of the
agreement and the anticipated annual amount of the rental obligation to be paid by the Department
of Corrections; and
WHEREAS, Senate Bill 142 states at the end of the term of the lease-purchase agreement,
the state shall own the correctional facility; and
WHEREAS, Senate Bill 142 states the addition must be designed and constructed so as to
provide secure classroom facilities and housing for prisoners transferred to Spring Creek Correctional
Center to use those facilities and that not fewer than 150 additional beds shall be constructed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council supports the passage of Senate Bill 142.
Section 2. This resolution shall take effect immediately upon its adoption.
