HomeMy WebLinkAboutOrd1997-016 I I I Sponsored by: Planning & Zoning Commission Introduction Date: May 27. 1997 Public Hearing Date: June 9.1997 CITY OF SEWARD, ALASKA ORDINANCE NO. 97-16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, AMENDING THE LAND USE PLAN AND ZONING OF LOTS 12- 16 AND 26-28, BLOCK 8, ORIGINAL TOWNSITE OF SEWARD TO CENTRAL BUSINESS DISTRICT WHEREAS, Kueuit Enterprises Inc. submitted an application and $250.00 filing fee, requesting that the Land Use Plan and Zoning of Lots 12-16 and 26-28, Block 8, Original Townsite of Seward, be amended to Central Business District; and WHEREAS, SCC S 15.01.035, Zoning Code, requires that applications to amend zoning and land use district boundaries include the signatures of a majority of the property owners in the area to be amended; and WHEREAS, of the three property owners, Arlene Wiley and Kim Hasty signed the application; and WHEREAS, the current Land Use Plan designation of Lots 12-16, Block 8, OTS is Urban Residential and the current Zoning is Auto Commercial; and WHEREAS, the current Land Use Plan designation of Lots 26-28, Block 8, OTS is Central Business District and the current Zoning is Multi-Family Residential; and WHEREAS, the proposed land use and zoning changes are requested to facilitate the development of a hotel which will also include a restaurant/bar and gift shop; and WHEREAS, the property is surrounded by a variety of existing land uses including institutional, residential, multi-family residential and commercial; and WHEREAS, at its May 7, 1997 meeting, the Planning & Zoning Commission held a public hearing and recommended conditional Land Use Plan and Zoning amendments pending sale, transfer and development of the property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: Section 1. The Official City of Seward Land Use Plan Map is hereby amended by conditionally changing the land use designation of Lots 12-16, Block 8, OTS from Urban Residential to Central Business District. CITY OF SEWARD, ALASKA ORDINANCE NO. 2H.Q Section 2. The Official City of Seward Zoning Map is hereby amended by conditionally changing the zoning designation of Lots 12-16 and 26-28, Block 8, Original Townsite of Seward to Central Business District. Section 3. The rezone of Lots 26-28, Block 8, Original Townsite of Seward, to Central Business District shall become effective concurrent with the transfer of said lands by the present owner to any purchaser within 12 months of the effective date of this ordinance. In the event the property is not sold and conveyed to a new owner within 12 months of the effective date of this ordinance, the zoning shall revert to R3. Section 4. The land use designation and rezone of Lots 12-16, Block 8, Original Townsite of Seward, to Central Business District shall become effective concurrent with the transfer of said lands by the present owners to any purchaser within 12 months of the effective date of this ordinance. In the event the property is not sold and conveyed to a new owner within 12 months of the effective date of this ordinance, the land use designation and zoning shall revert to DR and AC respectively. Section 5. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 9th day of June, 1997.
