Sponsored by: Crane & Anderson CITY OF SEWARD, ALASKA RESOLUTION NO. 95-027 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF SEWARD THE QUESTION OF AMENDING ~~ 2.13(A), 3.1 AND 3.2 OF THE CHARTER OF THE CITY OF SEWARD ON OCTOBER 3, 1995 WHEREAS, Section 14.2 of the Charter of the City of Seward provides that the Charter may be amended by proceedings commenced by the votes of four members of the Council; and WHEREAS, Section 14.3 of the Charter of the City of Seward provides that when an amendment to the Charter is proposed by the Council, it shall be submitted to the qualified voters of the City at any election to be held in the City not less than 60 days after its proposal by the Council; and WHEREAS, it is in the best interest of the City and its residents that Section 2.13(a), 3.1 and 3.2 of the Charter of the City of Seward be amended as set forth below. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Council hereby proposes that Sections 2.13(a), 3.1 and 3.2 of the Charter of the City of Seward be amended to read as follows: Sec. 2.13(a). Filling vacancies. (a) If a vacancy occurs m an elective office, other than a vacancy occurring from a recall: (1) if the vacancy occurs more than two weeks before the last time for filing for the offices to be filled at the next regular city election the council shall fill the vacancy by appointment within thirty days, with the person appointed serving until the next time when terms of elective officers begin. If the unexpired term of the vacated office extends beyond the next time when terms of elective officers begin, the office shall be filled for the remainder of the unexpired term at the next regular city election. (2) If the vacancy occurs no more than two weeks before the last time for filing declarations of candidacy for offices to be filled at the next regular city election, the council shall not fill the vacancy until immediately after the council organizes following such regular city election, and the council then shall fill any such vacancy by appointment, with the person appointed serving until the next time when terms of elective officers begin. If the unexpired term of the vacated . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 95-027 the office shall be filled for the remainder of the unexpired term at the next regular city election. Sec. 3.1. Comvosition: Powers and Duties Generallv: Term of Office. (a) The council shall consist of the mayor and six councilmembers. The mayor and each councilmember shall be elected from the city at large. The council shall exercise all of the legislative and policy-making powers of the city and shall provide for the performance of all duties and obligations imposed upon the city by law. (b) The term of office of an elective officer shall commence immediately before the Council organizes following the officer's election. The term of office of an elective officer that commenced before the 1996 regular city election shall be two years. Commencing with the mayor elected at the 1997 regular city election, the term of the mayor shall be three years. At the 1996 regular city election, two councilmembers shall be elected for terms of three years, and one councilmember shall be elected for a term of two years. At the 1997 regular city election, two councilmembers shall be elected for terms of three years, and one councilmember shall be elected for a term of one year. Sec. 3.2. Exviration of Terms: Oualified Appointees to Fill Vacancies. Commencing after the 1997 regular city election, the terms of two councilmembers shall expire in each year, except that in each third year, counting from 1997, the terms of the mayor and of two councilmembers shall expire. When appointments are made to fill vacancies in the manner provided in Section 2.13 (a) of this Charter, appointees shall qualifY for and assume the duties of office within ten days after appointment, unless such time be extended for not more than sixty days by the council. Section 2. An election is to be held on October 3, 1995, in and for the City of Seward, for the purpose of submitting to the qualified voters of the City of Seward a proposition substantially in the following form: PROPOSITION NO. AMENDMENT OF SEWARD CITY CHARTER SECTIONS 2. I 3 (a). 3.1 AND 3.2 Shall Sections 2.13(a), 3.1 and 3.2 of the Charter of the City of Seward, relating to terms of office of elective officers, be amended to read as follows: Sec. 2. 13(a). The amendment proposed by this resolution shall be published not less than two weeks nor more than four weeks before the October 3, 1995, election, at the same time and in the same manner as the notice of that election. Section 4. This resolution shall take effect immediately upon its adoption. The amendment set forth in Section I shall become effective following certification of the October 3, 1995, regular city election if approved by a majority of the qualified voters voting on the question at that election and the filing of the amendment as provided in Section 14.7 of the Charter of the City of Seward.
