RESOLUTION NO. 94-116
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, PROVIDING FOR THE SUBMISSION
TO THE QUALIFIED VOTERS OF THE CITY OF SEWARD THE
QUESTION OF AMENDING SECfION 3.6(c) AND ENACfING CHAPTER
16 OF THE CHARTER OF THE CITY OF SEWARD AT AN ELECfION
IN AND FOR THE CITY OF SEWARD ON OCTOBER 4, 1994
WHEREAS, Section 14.2 of the Charter of the City of Seward provides that the
Charter may be amended by proceedings commenced by the vote of four members of the
council; and
WHEREAS, Section 14.3 of the Charter of the City of Seward provides that when
an amendment to the Charter is proposed by the council, it shall be submitted to the
qualified voters of the City at any election to be held in the City not less than 60 days
after its proposal by the council; and
WHEREAS, it is in the best interest of the City and its residents that Section 3.6(c)
of the Charter of the City of Seward be amended and Chapter 16 of the Charter of the
City of Seward shall be enacted as set forth below.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The council hereby proposes that Section 3.6(c) of the Charter of the
City of Seward, relating to public health facilities, be amended, and that Chapter 16 of
the Charter of the City of Seward, relating to public health facilities, be enacted to read
as follows:
Section 3.6(c):
(c) Boards established by the council shall not be
authorized to employ or direct the employment or removal of
any administration officer or employee of the city.

Sec. 16.1. Establishment of Board.
The council may provide in the Code for a citizen
board to manage public health facilities owned or operated by
the city.
Sec. 16.2. Powers of Board.
The council shall specify in the Code the powers of
any board established under section 16.1. Notwithstanding
anything in this Charter to the contrary, the council may
provide in the Code that:
(a) The board shall employ or be responsible for the
employment of public health facility employees, and super-
vise and coordinate the personnel policies and practices
applicable to such employees.
(b) The board shall, no later than the time specified in
the Code, submit to the council a proposed budget for the
following fiscal year for approval of the total amount. Within
the time specified in the Code, the council shall determine the
total amount of money to be make available to the board
from local sources. If the council does not, within the time
specified in the Code, furnish the board with a statement of
the sum to be made available, the amount requested in the
budget is automatically approved. Not later than the time
specified in the Code, the council shall appropriate the
amount to be made available from local sources from money
available for the purpose.
(c) Contracts related to public health facilities shall be
authorized by the board and executed on behalf of the city by
a person designated by the board.
Section 2. An election is to be held on October 4, 1994, in and for the City of
Seward, for the purpose of submitting to the qualified voters of the City of Seward a
proposition substantially in the following form:

facilities, be amended, and Chapter 16 of the Charter of the City of Seward, relating
to public health facilities, be enacted to read as follows:

Section 3. The amendment proposed by this resolution shall be published not less
than two weeks nor more than four weeks before the October 4, 1994 election, at the
same time and in the same manner as the notice of that election.
Section 4. This resolution shall take effect immediately upon its adoption. The
amendment set forth in Section 1 shall become effective upon its approval by a majority
of the qualified voters voting on the question at the election of October 4,1994, and the
filing of the amendment as provided in Section 14.7 of the Charter of the City of Seward.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
25th day of July, 1994.
