RESOLUTION NO. 96-017
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, CALLING A SPECIAL ELECTION
TO BE HELD ON TUESDAY, MAY 21,1996, FOR THE PURPOSE
OF AUTHORIZING THE SALE OF GENERAL OBLIGATION BONDS
OR LEASE OBLIGATIONS FOR CAPITAL FACILITIES CONSTRUCTION
AND TO AUTHORIZE THE TRANSFER OF ASSETS AND LIABILITIES
FROM SEWARD GENERAL HOSPITAL TO PROVIDENCE ALASKA
MEDICAL CENTER
WHEREAS, the City Council instructed the City Manager to begin negotiations with
Providence Alaska Medical Center for a possible transfer of hospital operations to Providence; and
WHEREAS, these negotiations will be completed once Providence officials have completed
their analysis of a proposal to transfer assets and liabilities of the hospital to them for the purpose
of operating health care facilities in the City of Seward; and
WHEREAS, it is anticipated that part of the contract for transfer of the hospital operations
to Providence will include a requirement that the City contribute to capitalizing the hospital
operation by funding a portion of the construction of a new health care facility to house hospital and
other health care operations; and
WHEREAS, this funding would require the sale of general obligation bonds or lease
obligations of the City; and
WHEREAS, the significance of the proposed transfer warrants submitting the proposed
transfer and its financing to the voters of the City for their approval; and
WHEREAS, the City of Seward is required to preclear any special election date with the
Department of Justice prior to a special election of the City; and
WHEREAS, in order to facilitate Department of Justice approval within the time frame
required to proceed with the hospital transfer it is necessary to set the date of election prior to
drafting of the actual documents to be the subject of voter approval at the special election; and
WHEREAS, it is the intent of the City to complete preparation and Council approval of all
documents which will be the subject of the special election at least thirty days prior to the special
election as required by Charter and by law; and

WHEREAS, it is in the public interest to seek voter approval of the hospital transfer and its
fmancing as soon as possible in order to allow for an orderly transfer of operations prior to the end
of the 1996 Fiscal Year if the transfer and financing are approved by the voters;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Clerk is hereby directed to set a special election of the City of Seward
to be conducted on May 21, 1996, in accordance with City Code and Charter provisions for the
calling of special elections for the purpose of seeking voter approval of the transfer of assets and
liabilities of Seward General Hospital to Providence Alaska Medical Center and voter approval of
obligations of the City to finance the transfer.
Section 2. The City Clerk is further directed to seek expedited preclearance of the special
election date from the U. S. Department of Justice as required by the Federal Voting Rights Act of
1972.
Section 3. This resolution shall take effect immediately upon its adoption.
