RESOLUTION 99-081
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE LEASE DISPOSAL OF +/- 8,000 SF OF
PUBLIC LAND WITHIN THE NORTH HARBOR 72-HOURPARKING LOT,
TRACT A NORTH HARBOR SUBDIVISION, FOR PUBLIC SAFETY AND
TRAFFIC CONCERNS
WHEREAS, on September 1,1998, James T. Pruitt submitted a request that the City make
+/- 12,800 SF (+/- 80' x +/- 160') of the North Harbor 72-Hour Parking Lot available for expansion
of City Lease 84-043; and
WHEREAS, the request has been considered in light of the lease policies and procedures
established by Resolution 94-101, and the lease expansion has been reviewed by the Administration;
and
WHEREAS, the Planning and Zoning Commission held a public hearing on October 7,
1998, and made recommendations to the City Council based on Mr. Pruitt's proposal and staff
comments; and
WHEREAS, the City Council on December 18, 1998, by unanimous motion following
review of the Planning and Zoning Commissions comments, directed the City Administration to
negotiate a lease with Mr. Pruitt in order to mitigate public safety and traffic concerns; and
WHEREAS, the Administration acknowledges a legitimate public safety concern and has
negotiated a lease expansion, consistent with Council and Planning and Zoning direction, that
addresses the issue; and
WHEREAS, SCC 7.05.120 allows the City Council to dispose of an interest in real property
by negotiation, public auction, or sealed bid; and
WHEREAS, it was determined to be in the public interest to dispose of the proposed area
through negotiation; and
WHEREAS, it was determined to be in the public interest to not require a new appraisal
prior to disposal due to the fact that the adjacent City leased property was appraised in 1995 and City
leased land is expected to be re-appraised by July 1,2000, and City lease payments will be adjusted
to fair market rental value; and
WHEREAS, in accordance with SCC 7.05.125 the City Council held a public hearing on
June 28, 1999, following at least 10 days of public notice;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Approximately 8,000 square feet of public property that is currently a part ofthe
southern portion of the North Harbor 72-Hour Parking Lot, adjacent to City Lease 84-043, is made
available for long-term lease disposal through negotiation to mitigate certain public safety and traffic
concerns.
Section 2. It is in the public's interest to allow the disposal of this public property through
negotiation and without the requirement of an appraisal because the adjacent City leased property
was appraised in 1995, the City leased land is expected to be appraised by July 1,2000, and City
lease payments will be based on fair market rental value as determined by an appraisal.
Section 3. Prior to the effectiveness of a new lease incorporating the real property described
in Section 1, the lease site will be surveyed and replatted to identify the new lease area, the modified
North Harbor 72-Hour Parking Lot, and the surrounding right-of-ways and related areas.
Section 4. No new lease incorporating the expanded lease site may become effective until
the above mentioned replat is completed, which replat shall occur no later than December 31, 1999
or the authorization to dispose of the public land described in this resolution shall terminate.
Section 5. Instructions for the survey and replat shall be prepared by the City and the final
survey and replat is subject to the City's approval.
Section 6. This resolution shall take effect 30 days following its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 28 day
ofJune, 1999.
