CITY OF SEWARD, ALASKA
RESOLUTION NO. 96-042
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE LEASE OF CERTAIN
LANDS WITHIN THE SEWARD MARINE INDUSTRIAL
CENTER TO KETCHIKAN PULP COMPANY
WHEREAS, in order to encourage investment and employment opportunities within the
community, the City Council has determined that the continued development of Seward Marine
Industrial Center is in the public interest; and
WHEREAS, Ketchikan Pulp Company proposed to enter into a long-term lease agreement
with the City for the purpose of storing and staging logs on the below-identified site; and
WHEREAS, the City and Ketchikan Pulp Company have concluded negotiation ofthe lease
agreement; and
WHEREAS, it is the intent of this lease to relieve the City of the entire burden of
compliance with present or future environmental regulations or controls with respect to the Lessee's
operations on or adjacent to the leased land during the lease term;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The long-term lease of approximately 146,708 square feet, more or less, and
described as Lots 1 and 2, Block 3, Seward Marine Industrial Center, to Ketchikan Pulp Company
for the purpose of storing and staging logs, is hereby APPROVED. A copy of the essential terms
and conditions of the lease is attached and incorporated herein be reference.
Section 2. The above referenced lease is subject to suspension during the first thirty days
after passage and posting of this resolution if a sufficient referendary petition is filed in accordance
with ~4.8 of the City Charter.
Section 3. The City Manager is hereby authorized and instructed to execute the lease
agreement on behalf of the City on the date it becomes effective.
Section 4. This resolution shall take effect thirty days after passage and posting as required
bylaw..
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 8th day
of April, 1996.

KETCHlKAN PULP COMPANY LEASE
ESSENTIAL TERMS AND CONDITIONS
A tract ofland measuring 146,708, more or less, depicted as Parcels 2-3 and
2-4 on Exhibit "A" of the lease and attached hereto, more commonly
described as Lots 1 and 2, Block 3, Seward Marine Industrial Center
The lease will run from the effective date (30 days after passage and posting
of the resolution) for one year, terminating on May 8, 1997. There is no
provision for term extensions and there are no rights of first refusal.
Ten Cents ($0.10) per square foot (fair market value) for the full term of the
lease.
Through the lease term, the wharfage rate for logs handled at City facilities
will be Seventy-five Cents ($0.75) per ton.
Through the lease term, the moorage rate will be the current rate set forth in
the Seward Port and Harbor Tariff.
Logs will be staged next to the North Dock, at no charge, up to ten days as
set forth in the Seward Port and Harbor Tariff.
