Home My WebLink AboutRes1996-052 I I , Sponsored by: Bencardino CITY OF SEWARD, ALASKA RESOLUTION NO. 96-052 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, REQUESTING THE LEGISLATURE TO AMEND AS 43.75.015 AND 43.75.130 TO REAPPORTION THE MUNICIPAL SHARE OF THE FISHERIES BUSINESS TAX FROM THE POINT OF PROCESSING TO THE PORT OF LANDING WHEREAS, the fisheries business tax collected by the State of Alaska is based on the species, value of fish and whether processed on or off shore; and WHEREAS, the fisheries business tax is a complex formula based on six different rates which are assessed on the value of the respective seafood products; and WHEREAS, under AS 43.75.015 and 43.75.130, the state receives 50% of the tax collected with the remaining 50% divided equally between the borough and the city where the fish was processed; and WHEREAS, the port oflanding offish processed on shore is heavily impacted by ships off- loading their cargo, yet is not compensated under the fisheries business tax program; and WHEREAS, absent the docks and other services provided by the port of landing, on-shore processing of fish caught in Alaskan waters would be impossible; and WHEREAS, often, fish are processed in a city other than the port of landing, thereby diverting significant amounts offish tax revenues from the port oflanding to the point of processing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Alaska Legislature is urged to amend AS 43.75.015 and AS 43.75.130 to reapportion the municipal share of the Fisheries Business Tax from the point of processing to the port oflanding. Section 2. A copy of this resolution shall be forwarded to Governor Tony Knowles, Senate President Drue Pearce, Representative Gary Davis, House Speaker Gail Phillips and Senator John Torgerson. Section 3. This resolution shall take effect immediately upon its adoption.
