CITY OF SEWARD, ALASKA
RESOLUTION NO. 96-112
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE DISPOSAL OF CITY
PROPERTIES DECLARED TO BE SURPLUS TO THE NEEDS OF THE CITY
WHEREAS, the City's Municipal Lands Management Plan recommends that developable
parcels identified as excess to the City's present and anticipated public needs to declared surplus and
made available for public and private acquisition; and
WHEREAS, a number of properties have been identified that are available for disposal; and
WHEREAS, the Moose Pass Volunteer Fire Company is in the process of establishing
FirelEMS stations along the Seward Highway and has asked the City to donate Lot 10, Block 2, Goat
Haven Estates, to it for that purpose; and
WHEREAS, such a donation would be a benefit to the safety and welfare of Seward's
neighbors and the traveling public; and
WHEREAS, in accordance with Seward City Code Chapter 7.05, Article 3, the City Council
has conducted a properly noticed public hearing on the disposal of surplus city land;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to dispose of city owned properties listed
below by sealed bid, subject to appropriate public utility and access easements being executed prior
to the transfer of any deeds. A twenty percent (20%) cash bid deposit must be submitted with all
bids with the balance due within 30 days of the bid opening. The City reserves the right to reject any
and all bids received.

B. The following parcels may be disposed of by sealed bid with minimum bid prices
established as noted:
1. Lots 1 and 2 and 17-22, Block 5, Cliff Addition [Minimum bid to be the cost
of acquiring reverter interest from the federal government.]
2. Lots 36 and 37, Block 17, Original Townsite [Minimum bid to be sufficient
to cover delinquent taxes, penalties, interest and administrative costs.]
3. Lots 17 and 18, Block 22, Original Townsite [Minimum bid to be sufficient
to cover delinquent taxes, penalties, interest and administrative costs.]
Section 2. The City Manager is hereby authorized to execute the attached deed, incorporated
herein by reference, to transfer Lot 10, Block 2, Goat Haven Estates, to the Moose Pass Volunteer
Fire Company for the purpose of establishing a Fire/EMS Station site to serve the local residents of
the Mile 37 area and the traveling public along the Seward Highway.
Section 3. This resolution shall take effect thirty days after passage and posting as required
by law.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 26th
day of August, 1996.

QUIT CLAIM DEED
The GRANTOR, the City of Seward, Alaska, a municipal corporation of the State of Alaska, with
an address of P.O. Box 167, Seward, Alaska 99664, for and in consideration of the sum ofTEN and
NO/lOO ($10.00) DOLLARS and other good and valuable consideration, in hand paid, and pursuant
to City Council Resolution No. 96-_ adopted August 26,1996, by its authorized officer does
hereby quitclaim and convey unto the GRANTEE, the Moose Pass Volunteer Fire Company, an
Alaska non-profit corporation, receiving mail at P.O. Box 104, Moose Pass, Alaska 99631, all the
right, title and interest of the Grantor in and to the following described real property subject to the
conditions set forth herein:
Lot 10, Block 2, Goat Haven Estates according to Plat NO.77-12 in the Seward Recording
District, Third Judicial District, State of Alaska
This quitclaim deed is subject to the following reservations and conditions:
1. Within one (1) year Grantee shall begin applying for grants to construct a fire/emergency
medical services (EMS) facility on said property, and shall complete such construction on or before
ten (10) years from the date of this quitclaim deed; failure to complete such construction shall compel
the Moose Pass Volunteer Fire Company to offer to resell the lot plus its improvements to the City
of Seward for a total consideration ofTen Dollars ($10.00).
2. The uses of the lot shall be confined to that of a fire/EMS facility for the Moose Pass
Volunteer Fire Company; failure to use the lot for that purpose shall compel the Grantee to offer the
lot for resale to the City of Seward on the same terms as described in numbered paragraph 1 above.
3. Should the Grantee otherwise desire to sell the lot, the City hereby reserves a right of first
refusal thereon and the consideration for the lot and any improvements thereof shall be the sum of
Ten Dollars ($10.00).
