RESOLUTION 99-096
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING ALAND USE AGREEMENT WITH COOK INLET
AQUACULTURE ASSOCIATION FOR USE OF CITY OWNED TAX
PARCEL 125-370-90 AT MILE 6.5 SEWARD HIGHWAY ON GROUSE
CREEK FOR A SALMON HARVEST SITE
WHEREAS, Cook Inlet Aquaculture Association (CIAA) has an established
commercial sockeye stocking and harvesting program in the Seward area with proceeds used to
sustain its financial abilities to carry out aquaculture projects throughout the Cook Inlet, Kenai
Peninsula and Resurrection Bay areas; and
WHEREAS, CIAA normally harvests fish in the upper reaches of Salmon Creek however,
for the second year in a row, excessively high water flows are preventing the establishment of
weirs to facilitate the harvesting of returning salmon; and
WHEREAS, CIAA has identified a suitable harvest location on city electric transmission
line property along Grouse Creek; and
WHEREAS, Seward City Code Section 7.05.410 authorizes the city manager to negotiate
short term land use agreements or leases subject to city council confirmation at the next regularly
scheduled meeting; and
WHEREAS, this same location was authorized under a similar agreement with CIAA in
1998; and
WHEREAS, the CITY desires to cooperate with CIAA to provide access to and space in
and along Spring Creek to accommodate a proposed fish stocking and harvesting site:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The short term Land Use Agreement between the City of Seward and Cook
Inlet Aquaculture Association, attached and incorporated herewith by reference, for use of city
owned property identified as Kenai Peninsula Borough Tax Parcel # 125-370-90 on Grouse Creek
at about Mile 6.5 Seward Highway is approved.

Section 2. Due to the immediate need to harvest the fish, the short duration of the use and
the non-profit status of Cook Inlet Aquaculture Association, it is in the public interest not to charge
a fee for the use of the above referenced city land.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 12th
day ofJuly, 1999.
