CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-129
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING A NEW CONTRACT
WITH AMERICA NORTH FOR THE LOWELL POINT LAGOON PROJECT
WHEREAS, the Alaska Department of Environmental Conservation has
determined the sludge in the Lowell Point Sewage Lagoon to be a hazardous material
under provisions of Alaska State Law; and
WHEREAS, because of this determination by ADEC designating the sludge as a
hazardous waste containing hydrocarbons and because the Seward Landfill has been
closed, a new plan for composting had to be devised and approved by ADEC; and
WHEREAS, America North was already involved with the planning of this project
and was prepared to revise its plan to meet ADEC requirements; and
WHEREAS, the city administration determined that America North was the best
qualified firm to complete the work in a timely manner to meet the schedule of the US-
EP A compliance order; and
WHEREAS, the cost of the additional work necessary to revise the plan is
estimated to be $34,753; and
WHEREAS, the provision of professional services is specifically exempted from
standard city bid procedures;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is hereby authorized to enter into a new contract
with America North in the amount of $34,753 to provide professional services necessary
to revise the plan for disposal of sludge from the Lowell Point Sewage Lagoon, to
respond to ADEC concerns and to provide technical assistance during implementation
of the plan.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
27th day of July, 1992.
