CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-166 SUBSTITUTE
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROPRIATING FUNDS FOR THE
ACQUISrtION OF A HI-CUBE V AN, A USED CAB FOR A
RESCUE VEHICLE AND A 3,000 GALLON WATER TANKER
AND APPROVING THE PURCHASE OF USED EQUIPMENT
WITHOUT FULL UTILIZATION OF CITY BID PROCEDURES
WHEREAS, during the winter of 1991, a fire occurred in the engine compartment
of Rescue I, damaging equipment and supplies in the rescue truck and causing smoke
damage throughout the Fire Hallj and
WHEREAS, repairs, cleaning and replacing the equipment in Rescue I and
cleaning and painting the Fire Hall were accomplished within the existing Fire
Department Budgetj and
WHEREAS, all attempts to procure a used replacement cab and interior for Rescue
I have been unsuccessfulj and
WHEREAS, a used replacement cab and interior can be purchased from a
Chevrolet Dealership in Eatonville, Washington, for approximately $21,oooj and
WHEREAS, the Water Department is in need of a Hi-Cube Vanj and
WHEREAS, a used Hi-Cube Van is available from the same supplier who has
offered to provide the used replacement cab for Rescue Ij and
WHEREAS, the supplier has offered to place the replacement cab inside the Hi-
Cube Van for shipping, thus saving shipping costs to the city; and
WHEREAS, the city Street Department's tanker/pumper is in very poor condition,
is unsafe and is complete unreliablej and
WHEREAS, the tanker/pumper is used by the Fire Department, the Street
Department, the Water/Sewer Department and the Parks and Recreation Department
throughout the yearj and
WHEREAS, a refurbished 1984 Ford Chassis with an in-frame rebuilt engine, a
new 3,000 gallon tank and a new 750 g.p.m. pump is available in Denver for a total cost
of $38,950, excluding shipping; and

1. If the proposed lease is approved by the City Council, the resolution
approving the lease and the lease agreement shall be posted for thirty days as required
by the City Code. Barring the filing of a sufficient referendum petition to set aside the
lease, the lease shall then become effective 30 days after passage and posting. Once the
lease agreement becomes effective, the city shall deduct from the performance bond all
lease preparation costs incurred by the city, including but not limited to appraisals,
attorney and staff time, advertising and other incidental costs. The remainder of the
performance bond, if any, shall be credited towards the rents due, and the Lessee shall
be billed in accordance with the city's quarterly lease billing cycle.
2. In the event the City Council rejects the proposal or fails to approve
the lease agreement within 45 days of the date the negotiated lease agreement is first
presented to the City Council, the total deposit shall be returned to the prospective
Lessee.
F. The City Council may waive all or any part of these requirements as it
deems necessary to ensure successful completion of the lease negotiations.

WHEREAS, the city received $39,686 in insurance settlement fees as a result of the
1991 fire, and these funds, which were received in FY 1992, have been deposited in the
city's Fund Balancei
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The sum of $43,637 is hereby appropriated from the General Fund
Fund Balance Account No. 101-3070 as follows:

Section 2. It is in the public interest to waive competitive bid procedures for the
purchase of the above listed equipment, and the City Manager is hereby authorized to
purchase a Used Hi-Cube Van, a cab for the city's rescue vehicle and a 3,000 gallon
tanker/pumper from Van Eaton Chevrolet in Eatonville, Washington.
Section 3. This resolution shall take effect immediately upon its adoption.

28th day of September, 1992.
