RESOLUTION NO. 99-104
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO GRANT
PERMISSION FOR KODIAK LUMBER, LTD., AN ALASKA
CORPORATION, (DBA AS AFOGNAK LOGGING) TO BID ON A ROCK
SUPPLY CONTRACT ON THE BASIS OF A $1.00/TON PAYMENT TO THE
CITY FOR ROCK REMOVED FROM OUR SEWARD MARINE INDUS-
TRIAL CENTER ROCK QUARRY, AND FURTHER AUTHORIZING THE
CITY MANAGER TO ENTER INTO A CONTRACT WITH KODIAK
LUMBER, LTD. BASED ON PAST ROCK SUPPLY CONTRACTS FOR THE
SAME LOCATION
WHEREAS, Kodiak Lumber, Ltd., an Alaska Corporation, (dba as Afognak Logging) has
requested permission from the City to prepare a bid for supplying rock from the City owned rock
quarry adjacent to the Fourth of July Creek in the Seward Marine Industrial Center to a project in
the Matanuska-Susitna Borough at Point MacKenzie; and
WHEREAS, if successful, Kodiak Lumber, Ltd. will pay the City $1.00/ton for rip-rap
removed from the City's rock quarry; and
WHEREAS, approximately 75,000 yards of rip-rap is required for this contract; and
WHEREAS, the City Council has determined the public interest would be best served by
not requiring competitive bids/proposals and makes the following findings:
1) Kodiak Lumber already has contract rights to operate within the quarry to access rock
for the sawmill site so there would be no conflict in work crews and allowing Kodiak
Lumber to supply the rock will promote a safe work site; and
2) The only other potential operator in the Seward area who has the expertise or the
apparent desire to purchase the City's rock has declined to express an interest; and
3) Because there is no one else in the area who is capable or interested in purchasing
rock from the City's quarry, then no one else is treated unfairly and an extensive
bidding process would merely add cost and time;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council hereby approves Resolution 99-104, authorizing the City
Manager to grant permission for Kodiak Lumber, Ltd. to bid on a rock supply contract on the basis
of a $1.OO/ton payment to the City for rock removed from our Seward Industrial Marine Center rock
quarry, and in the event Kodiak Lumber Ltd' s bid is successful, further authorizing the City Manager

to enter into a contract with Kodiak Lumber, Ltd. based on past rock supply contracts for the same
location for a term less than 5 years and subject to additional terms as may be deemed necessary by
the City to protect the City's interest.
Section 2. The City Council has determined the public interest would be best served by not
requiring competitive bids/proposals and makes the following findings:
1) Kodiak Lumber already has contract rights to operate within the quarry to access rock
for the sawmill site so there would be no conflict in work crews and allowing Kodiak
Lumber to supply the rock will promote a safe work site; and
2) The only other potential operator in the Seward area who has the expertise or the

Section 3. This resolution shall take effect immediately upon its adoption.
