CITY OF SEWARD, ALASKA
RESOLUTION NO. 92-174
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING THE NEGOTIATION FOR
AND PROCUREMENT OF CONSTRUCTION SERVICES FOR THE
COMPLETION OF THE SLUDGE REMOVAL CONTRACT
WHEREAS, the City, through competitive sealed bidding under Title 6 of the
Seward City Code, solicited bids and awarded a contract for the removal and disposal
of sludge from Lowell Point Sewage Lagoon (sludge removal contract) to the lowest
responsive bidder, Alaska Boiler & Heat Exchanger Service, Inc., dba AB&H Construction
(AB&H Construction); and .
WHEREAS, the contract between the City of Seward and AB&H Construction
required AB&H to complete the removal and disposal of sludge from the Lowell Point
Sewage Lagoon on or before October 16, 1992; and
WHEREAS, AB&H Construction failed to prosecute and complete the perfonnance
of the work in a timely fashion; and
WHEREAS, the City of Seward has tenninated the contract with AB&H
Construction by passage of Resolution No. 92-173 dated October 16, 1992; and
WHEREAS, through competitive sealed bidding, the City has solicited bids for the
repair and restoration of a sewage treatment facility at Lowell Point in order to bring the
City into compliance with the EPA's compliance order; and
WHEREAS, the City has issued a notice of intent to award to Construction &
Rigging, Inc. the contract for the construction of said sewage treatment facility; and
WHEREAS, the work plan of Construction & Rigging, Inc. anticipates the
construction of certain concrete work prior to winter cold weather conditions; and
WHEREAS, a delay in the perfonnance of said work threatens to prevent the City
from completing the construction of the sewage treatment facility according to the
milestones and timetable in the United States EP A Compliance Order, as amended; and
WHEREAS, VRCA Environmental Services, Inc. was the second lowest bidder on
the sludge removal contract; and

WHEREAS, the procurement procedures of competitive sealed bids in Section
6.10.210, et seq., would, if followed, delay the timely resumption of the work and delay
the commencement of the contract by Construction & Rigging, Inc.i and
WHEREAS, the work remaining to be perfonned is within the general scope of
the work which was previously submitted to competitive bidi and
WHEREAS, Section 6.10.130 provides that the restrictions and provisions of this
title [Title 6, Purchasing, Contracting Professional Services] shall not apply where the City
Council detennines and makes written findings that the public interest would be best
served by not requiring competitive bids/proposalsi
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council hereby detennines that the public interest would be
best served by not requiring competitive bids and proposals for the completion of the
sludge removal contract.
Section 2. The City hereby adopts as its written findings the provisions of this
resolution set out above.
Section 3. The City Manager of his designee is authorized to negotiate with and
enter into a contract for the completion of the work for the removal and disposal of
sludge from the Lowell Point Sewage Lagoon, provided, however, that the lump sum
price of the contract herein authorized shall not exceed the amount of Three Hundred
Ninety Eight Thousand Dollars ($398,000) with a project contingency of Thirty Thousand
Dollars ($30,000) for a total project cost of Four Hundred Twenty Eight Thousand Dollars
($428,000).
Section 4. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
16th day of October, 1992.
