CITY OF SEWARD, ALASKA
RESOLUTION NO. 93-003
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A CHANGE ORDER TO
THE AMERICAN NORTH/EMCON CONTRACT FOR SEWAGE
LAGOON SLUDGE REMOVAL AND DISPOSAL
WHEREAS, the contract for professional services necessary to remove and dispose
of sludge from the Lowell Point Sewage Lagoon was approved for the amount of
$102,430; and
WHEREAS, the actual cost of work performed to date, including special
consultants to work on site for the composting, exceeded the approved amount by
$12,066.25; and
WHEREAS, these additional costs resulted from unforeseen delays and demands
by the Alaska Department of Environmental Conservation, a need for special consultants
to visit the composting site and a need to respond to demands and allegations by the
contractor, AB&H Construction, that could not be fully anticipated at the time the
contract was increased in July; and
WHEREAS, the additional payment is required to close out American North's
professional services contract with the city; and
WHEREAS, if future professional services are required as the composting process
proceeds, such services will be obtained on an as needed basis;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The professional services contract between the city and American
North/EMCON is hereby increased in the amount of $12,066.25.
Section 2. The contract with American North/EMCON will be closed out following
payment of this final invoice.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
11th day of January, 1993.

TO: HONORABLE MAYOR AND MEMBERS OF CITY COUNCIL

SUBJECT: CHANGE ORDER TO INCREASE CONTRACT AMOUNT
The City Council authorizes the Professional Services Contract with American North for disposal
of the sludge by composting. The contract amount was increased by Resolution 92-129 dated
July 21, 1992. The additional cost at that time resulted from the requirement to redo the
disposal plan after DEC declared the sludge to be a hazardous waste. It was expected that
increase would provide sufficient funding to pay for the balance of professional services to be
done by American North.
Subsequently, the charges for American North exceeded the earlier estimate by $12,066.25.
Several factors contributed to this increase. DEC continued to delay approval of the disposal
plan and required additional information from American North. Experts from VA
EnvironmentaVEMCON, an associate of American North were required to visit the site at the
start up of composting and observe the work to comply with the requirements of DEC. These
trips cost a total of $7,828.26. During the time AB&H Construction was working AB&H raised
several questions regarding potential hazards, which had to be addressed by American North.
Upon payment of this invoice I intend to close out the contract with American North.
The compost piles are formed and generating heat, therefore, some digestion of sludge is
occurring over the winter. Next spring the process will have to be accelerated by blowing air
into the piles or other means. Very likely, a compost expert will be required again at that time,
however, to what extent cannot be determined at this time. I anticipate limiting such visits to
specially qualified persons on an on-call basis and not an open ended professional contract.
RECOMMENDATION:
That the City Council approve Resolution NO. tj 3 - 00 3 authorizing the City Manager to
increase the amount of the American North contract by $12,066.25 in order to payoff the
consultant and close out the contract.
