CITY OF SEWARD, ALASKA
RESOLUTION NO. 93-123
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, PROVIDING POLICY DIRECTION TO
THE CITY MANAGER REGARDING EXPANSION OF THE AREA
LEASED BY SEWARD SHIP'S DRYDOCK, INC. AT THE
SEWARD MARINE INDUSTRIAL CENTER
WHEREAS, James T. Pruitt, dba Seward Ship's Drydock, Inc. (SSD), has made a
request to lease additional land adjoining its current leased land; and
WHEREAS, SSD was required to compensate the city for property occupancy and
use outside its lease boundaries prior to beginning further negotiations; and
WHEREAS, SSD has compensated the city for land outside the lease boundaries
occupied between February 1, 1990 and August 1, 1993; and
WHEREAS, the recent arbitration between the City of Seward and SSD established
that the City has no obligations to SSD prior to the effective end of its lease on January
4, 1995; and
WHEREAS, the arbitration further established a land lease rate per square foot and
determined that SSD must complete construction of a 300 foot building prior to January
4, 1995; and
WHEREAS, the administration is requesting policy direction regarding further
lease negotiations with SSD for additional land adjacent to the current leased land;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Manager is authorized to enter into negotiations with SSD for
expansion of its lease at the Seward Marine Industrial Center.
Section 2. The City Council reaffirms the established policy that the shiplift is
intended to be a multiple user facility.
Section 3. SSD shall be offered property to the north, south and east of its current
leased land at the rate of $0.16 per square foot.
Section 4. None of the actions authorized in this resolution modify in any way
the results of the arbitration.

Section 5. The set of lease amendments envisioned by this resolution is contingent
on a finding that the amendments are critical to the continuation of SSD at SMIC. SSD
shall make available to an impartial third party designated by the city information
sufficient to enable that third party to determine the economic feasibility of SSD building
the 300' building with the firewall required by state fire code on the existing lease. The
impartial third party shall also identify SSD's financing capability.
Section 6. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
13th day of September, 1993.
