Sponsored by: Tones CITY OF SEWARD, ALASKA RESOLUTION NO. 93-159 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING AN AMENDMENT TO THE LEASE WITH JAMES T. PRUITI, DBA SEWARD SHIP'S CHANDLERY, INCREASING THE SIZE OF THE SEWARD SHIP'S DRYDOCK LEASE SITE AT THE SEWARD MARINE INDUSTRIAL CENTER WHEREAS, on September 22, 1988, the city entered into a lease agreement with James T. Pruitt, dba Seward Ship's Chandlery, for the lease of certain real property located within the Seward Marine Industrial Center; and WHEREAS, an Arbitrator's Decision and Order dated January 4, 1993, set forth certain rights and obligations of the city and the lessee; and WHEREAS, the lessee wishes to lease certain additional real property adjacent to the original lease site under the terms and conditions of the original lease as interpreted by the Arbitrator's Decision and Order; and WHEREAS, on November 22,1993, the City Council conducted a properly noticed public hearing to solicit public comment regarding the lease of additional real property to the lessee; and WHEREAS, it has been determined that it is in the public interest to amend the original lease to increase the size of the lease site to include the requested additional real property under the terms and conditions set forth in the attached Amendment to Lease Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. The Amendment to Lease Agreement, attached and incorporated herein by reference, between the city of Seward and James T. Pruitt, dba Seward Ship's Chandlery, is hereby APPROVED. Section 2. This resolution shall take effect on the later of (i) the date 30 days after its passage and posting, and (ii) the date the City Council finds that the Amendment to Lease Agreement is critical to the continuation of Seward Ship's Chandlery at the Seward Marine Industrial Center. As conditions to the making of the finding described above, Seward Ship's Chandlery shall make available to an impartial third party designated by the City information sufficient to enable that third party to determine the economic feasibility of Seward Ship's Chandlery building the 300' building with the firewall . . . CITY OF SEWARD, ALASKA RESOLUTION NO. 93-159 required by state fire code on the existing lease. The impartial third party shall also identify Seward Ship's Chandlery's financing capability..
