RESOLUTION NO. 93-164
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A CONTRACT WITH ALASKA
NEWSPAPERS, INC., FOR DISPLAY ADVERTISING IN THE
SEWARD PHOENIX LOG
WHEREAS, the city's contract for advertising in the Seward Phoenix Log will
expire on November 30,1993; and
WHEREAS, the Log has provided advertising services in the past and has given
the city a measure of flexibility in meeting deadlines in order to guarantee that
advertising occurs during established Code-required time frames; and
WHEREAS, the attached agreement with Alaska Newspapers, Inc., does not
obligate the city to advertise in the Log, but does guarantee a more favorable rate if the
city purchases a minimum number of column inches of advertising during a one-year
period; and
WHEREAS, it is in the public interest to publish the bulk of the city's ads in a local
newspaper, and the Phoenix Log is currently the only regularly published newspaper
with an office in the city of Seward;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. It is in the public interest to approve a contract for advertising without
full utilization of city bid procedures.
Section 2. The advertising contract to provide display advertising for the city for
the period December 1, 1993, through November 30, 1994, a copy of which is attached
and incorporated herein by reference, is hereby APPROVED.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this
22nd day of November, 1993.

Terms and Conditions
Alaska Newspapers. Inc. (ANn is a general interest. paid circulation community
newspaper network intended to be read by any member of a family. As such. the right is
reserved to edit and revise any advli'rtisement or to reject any ad for which ANI feels
there may be legal liability. Advertiser and/or advertiser's agent jointly and severally
agree to indemnify ANI from any loss. liability and expense arising out of such
publication.
ANI newspapers are five column. standard tabloid newspapers containing a net of 75
column inches per page (5 columns x 15 inches). Columns are 11 picas wide (1-13116
inches) with 1 pica (approximately 3116 inch) gutter between columns. Mechanicals are
3S follows: Maximum height: 15 inches. Maximum widths: I-column = l'I;S": ::l.column =
3-7;S": 3-column = S-I;S": 4-column = 7.7;S": 5-column = 9-7;S"; and double truck = 21".
Standard agency discount is offered to bona fide advertising agencies. Proof of agency
status may be required. Agency must submit advertising camera ready in order to qualify
for discount.
Specific location placement of ads will be honored to the extent available and feasible.
Advertiser may guarantee placement location with a 15% surcharge to the regular rate
paid by advertiser on a first come. first.served basis. Placements on the front page or the
editoriaVopinion page are not available.
Payments must be made NET 10 DAYS from date of invoice for credit-approved
accounts. CASH IN ADV ANeE is required for all political advertising and those accounts
that have not established credit approval in advance. Advertising contract terms of
payment are negotiable and subject to final approval of the President or General Manager
of ANI. ANI reserves the right to charge a service charge up to the maximum extent
permitted by law for those accounts past due aceording to these terms.
Non-typewritten ad copy cannot be guaranteed for accuracy. Although ANI accepts no
financial responsibility for typographical errors. if at fault ANI will reprint that portion of
the advertisement in which an error has occurred that materially affects its value. If an
advertising proof has been approved by the advertiser prior to publication. ANI reserves
the right to charge in full for that ad and for any subsequent placement of corrected ad. If
a paid advertisement has been omitted. ANI reserves the right to publish in its next
available issue t he advertisement so omitted or to refund up to but no greater than the
amount paid by advertiser.
Any advertisement composed by ANI is the property of ANI and written permission to
reproduce any part or all of such composition must be obtained from and granted by ANI
for purposes of printing in any other publication, or in any other form such as fliers,
posters. calendars, and the like. Permission shall not be reasonably withheld by ANI,
although a reasonable fee may be charged.
Based on the contract category - weekly or yearly - for which the advertiser signs, the
rate for all run-of-paper space used during the year shall be reduced or increased to the
appropriate rate based on the advertiser's performance. and the advertiser shall payor
receive a credit for the difference at the end of the contract year. An advertiser signing a
contract may earn lower rates only at the rate breaks within that frequency category and
may earn a lower rate to a point 3 brackets lower on the rate card.
The Publisher reserves the right to amend the terms. conditions. rates. etc. specified in this
contract upon thirty days notice in writing, and if such revision is not acceptable to the
customer, the customer shall have the right to terminate this contract at the date of
change, without penalty. A continuance of advertising after the new rates go into effect
will constitute acceptance of them and all other terms of this contract.
