RESOLUTION NO. 94-011
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AUTHORIZING THE ACQUISITION OF
THE REVERTER CLAUSE ASSOCIATED WITH THE SCHOOL RESERVE
LOCATED AT LOTS 1-2 AND 17-22, BLOCK 5, CLIFF ADDITION,
AND APPROPRIATING FUNDS
WHEREAS, the original plat of the Cliff Addition designated Lots 1-2 and 17-22,
Block 5, as School Reserve; and
WHEREAS, the 1953 deed from the federal government to the city included a
reverter clause restricting the use of this land to school purposes; and
WHEREAS, location, steep slopes and limited size preclude any practical use of
the property for school purposes, and the city has found no other public use for the
property; and
WHEREAS, the city has requested the Bureau of Land Management (BLM) to
remove the reverter clause in order that the city might surplus the property for
residential use; and
WHEREAS, the BLM has determined that the only legal method to remove the
school reserve reverter clause for residential development is for the city to purchase the
reverter interest which has been appraised at $10,800; and
WHEREAS, the borough assessed value of the property is $64,500;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. It is in the public interest that the city acquire the school reserve
reverter interest in Lots 1-2 and 17-22, Block 5, Cliff Addition, for an appraised fair market
value of $10,800.00, and the City Manager is hereby authorized to execute the necessary
documents to effect this acquisition.
Section 2. The amount of $10,800.00 is hereby appropriated from the General
Fund Fund Balance Account No. 101-0000-3050 to the General Fund Land Account No.
101-1180-5910.
Section 3. This resolution shall take effect thirty (30) days following passage and
posting as required by law.
