RESOLUTION NO. 89-120
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, REFERRING ORDINANCE NO. 619 TO
THE VOTERS AT A SPECIAL ELECTION TO BE HELD IN THE
CITY OF SEWARD, ALASKA, ON DECEMBER 5, 1989
WHEREAS, at its regular meeting of August 28, 1989, the City
Council enacted Ordinance No. 619, shortening the hours which bars
and liquor stores would be allowed to sell alcohol in the city of
Seward~ and
WHEREAS, on August 30, 1989, an application for a referendum
petition regarding this ordinance was filed with the City Clerk;
and
WHEREAS, a referendum petition was issued to the sponsors of
said referendum on September 5, 1989; and
WHEREAS, petition sponsors filed signed petitions with the
city Clerk on September 15, 1989; and
WHEREAS, the City Clerk certified the petition as sufficient
on september 22, 1989; and
WHEREAS, section 4. l5. 050 of the City Code requires that, when
a petition which has been certified as sufficient calls for a
referendum vote, the eity Council shall submit the matter to the
voters at a special election or at a regular election to be held
within 75 days of the date the petition is certified; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Pursuant to section 4.15.050 of the Seward City
Code, the following question shall be submitted to the qualified
voters of the city at a special election to be conducted on
December 5, 1989. An affirmative vote of a majority of those
qualified electors voting is required to repeal the ordinance.

RESOLUTION NO. 89-l20
Section 2. A person may vote at this election who possesses
the qualifications set forth in AS 15.05.010 and who has registered
to vote pursuant to Chapter 7 of Title 15 of the Alaska Statutes
and is qualified as set forth in section 4.01.055 of the Seward
city Code. The election shall be conducted in compliance with the
procedures established in Title 4 of the Seward city Code.
Section 3. Publication of this resolution shall be made by
posting a copy hereof on the City Hall bulletin board for a period
of four weeks prior to the election. In addition, copies of the
ordinance to be referred shall be made available at the city
Clerk's office for at least thirty (30) days preceding the date of
the election.
Section 4. This resolution shall take effect immediately upon
its adoption.
PASSED AND APPROVED by the city council of the city of Seward,
Alaska, this 9th day of October, 1989.
