CITY OF SEWARD, ALASKA
RESOLUTION NO. 89-148
OF
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
SEWARD, ALASKA, AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT FOR THE DISPOSAL OF THE
CITY-OWNED GRAIN TERMINAL COMPONENTS
WHEREAS, on August 14,
purchase, by the City of
components and an agreement
those components; and
1989, the City Council approved the
Seward, of certain grain terminal
for the development and marketing of
WHEREAS, subsequent to that purchase the city has made efforts
to encourage local development of the grain terminal facilities;
and
WHEREAS, the prospects of local development have been greatly
diminished by the sale by the State of Alaska of railroad cars
originally purchased for the transport of bulk commodities to
Seward in conjunction with operation of a grain export facility;
and
WHEREAS, the State of Alaska is negotiating the sale of the
grain terminal site which may result in the removal of foundations
and other improvements on the site which will reduce the possibili-
ty of local development; and
WHEREAS, the City has received an unsolicited offer for the
purchase of the grain terminal components in accordance with the
terms and conditions attached to this resolution; and
WHEREAS, the City Council finds that the disposal of the
property by public bid auction would not be in the public interest
and that a negotiated sale will provide the greatest financial
return to the City of Seward; and
WHEREAS, the City Council determines that it would be unlikely
for the City to receive a better offer for the components should
the current offer be rejected;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The Council finds that it would be in the public
interest to waive the formal procedures provided for in Title 6 and
7 of the Seward City Code for the reasons set forth above.

section 2. The City Manager is authorized to negotiate and
conclude the sale of the grain terminal components in accordance
with the proposal attached to this resolution.
section 3. This resolution shall take effect immediately upon
its adoption.
PASSED AND APPROVED by the City Council of the city of Seward,
Alaska, this 27th day of November, 1989.
