RESOLUTION NO. 97-001
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, APPROVING A SPECIAL EVENTS PERMIT FOR THE 1997
SEWARD POLAR BEAR JUMPOFF FESTIVAL, INC.
WHEREAS, Ordinance No. 92-12 provides that solicitation of funds or sales on city
property is prohibited unless specifically authorized by resolution of the City Council; and
WHEREAS, the Seward Polar Bear JumpoffFestival, Inc., has requested authorization to
utilize city property during January 18, 1997, to allow non-profit organizations to conduct special
events during the Eleventh Annual Polar Bear JumpoffFestival;
NOW, THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The Seward Polar Bear JumpoffFestival, Inc. is hereby authorized to utilize city
property to allow non-profit organizations to conduct special events for the period January 18, 1997,
and a special events permit, a copy of which is attached and incorporated herein by reference, is
hereby approved,
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 13th
day of January, 1997,

This permit covers activities on January 18, 1997, only,
To conduct the annual Polar Bear JumpoffFestival. Any events conducted on city
property by non-profit charitable, religious, civic and/or educational organizations,
other than the Permittee, must receive a separate permit for their activities. Activities
covered and authorized by this permit include:
. A parade - Line up on Washington Street in front of Legends
Restaurant at 10:30 a.m., with the parade beginning at II: 15 a.m. and
proceeding down Fourth A venue to the Small Boat Harbor. [NOTE:
Approved Parade Permit Application is attached.]

The "Plunge" - The dock in front of The Landing will be the sight of
the plunge into Resurrection Bay. 12:00 Noon - 4:00 p.m.
· Other miscellaneous activities associated with the festival.
. Permittee must have a valid Alaska State Business License, Kenai
Peninsula Borough Sales Tax Collection Permit and any other
local, state or federal permits or licenses required for applicants'
proposed activity. If such licenses or permits are not required for
scheduled activities, please disregard this portion of the permit.
· Permittee must maintain all festival and work sites in a neat and
orderly condition and guarantee that, upon completion of any work
or activity, the site is clear of all debris, trash, etc.
· Permittee must immediately notify the City of any spill of toxic or
hazardous materials.

Indemnity: The Permittee agrees to hold the City harmless and to defend the City from
all claims for personal injuries and/or property damage of every kind and
character relating to the Permittee's use or the use by Permittee's sublessees,
agents, customers and contractors.
Insurance: This permit will not become effective until such time as the City of Seward
has received the following:
· A Certificate of Insurance showing the City as co-insured in an
amount not less than the following: $1,000,000 General Liability
and Statutory Workmen's Compensation.
. All of the required insurance policies shall provide that the insurers
waive their rights for subrogation against the City and the Permit
Holder and their respective officers, servants, agents or employees.
Permit Holder further agrees to waive, and agrees to have its insurers
waive, any rights of subrogation with respect to deductibles under
such policies and with respect to damage to equipment, including the
loss of use thereof, whether insured or not.
· All insurance policies shall provide for thirty (30) days notice of
cancellation and/or material change to be sent to the City of Seward,
PO Box 167, Seward, AK. 99664, Attention: City Clerk.
· This permit may be canceled at any time by the City and will
automatically cancel, without notice from the City, if the insurance
policies required above are canceled for any reason.
Miscellaneous: This is the entire permit and is to be interpreted and applied by the City Clerk
or his designee in order to further the public interest. This Permit may be
modified only in writing. If the Permit Holder contests any decision made
by the City Clerk, the exclusive remedy shall be to the City Council, which
shall be the fmal judge of any dispute.
Termination: The City may terminate this Permit at any time for convenience, upon
delivery of written notice to Permit Holder 30 days prior to the date of
intended termination. If the pennit is terminated for convenience, the Permit
Holder shall promptly clear the permit site of all of its personal property or
that of its permittees.
