ORDINANCE NO. 98-06
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING SEWARD CITY CODE ~15.10.140 DEFINITIONS,
~15.10.215 PARKING, ~15.1O.225 LAND USES ALLOWED, ~15.10.320
CONDITIONAL USE PERMITS, ~15.10.325 VARIANCES AND ~16.01.015
SUBDIVISIONS CONDITIONS OF PLA T APPROVAL
WHEREAS, as times change, and the needs of the community change so should city
ordinances; and
WHEREAS,as conflicts between ordinance provisions are discovered the city code should
be adjusted to remove those conflicts; and
WHEREAS,on May 6, 1998 and June 3, 1998 the Planning and Zoning Commission held
public hearings and recommended the following amendments to the Seward City Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Amend SCC ~15.10.140 Definitions to read as follows:
Parking. Lot A structure or open area, other than a street, alley or other right-of-
way, on which five or more vehicle parking spaces are defined, designated or otherwise identified and
available, whether free or by compensation, for use by the public, clients, tenants, customers,
employees or owners of the property for which the parking area is required by ordinance.
Parking space, Vehicle. A space within a building or private or public parking lot,
exclusive of driveways, ramps, columns, office and work areas, for the parking of a vehicle.
Parking:. Valet. Attendant parking provided as a service to patrons of commercial
establishments.
Section 2. Amend SCC ~15.10.215 Parking to read as follows:
D. Minimum dimensions of ofT street spaces and aisles. The minimum dimensions of spaces and
aisles shall be as follows:
1. Parking spaces shall be at least eight and one half (8 112) feet wide and eighteen (18) feet
long.
2. The minimum width of traffic aisles providing access to parking lot spaces shall be:

E. Location:
1. Required parking may be provided on a lot that is not occupied by or abutting the principal
use, provided that (I) there is a pedestrian route not longer than 600 feet to the lot occupied by the
principal use, or (ii) access is provided by a scheduled shuttle service or a valet parking attendant.
Section 3. Amend SCC~ 15.10.225 Table of Land Uses Allowed as follows:
Clinic, Medical Outright use in OR, AC, HC, CBD, and INS
Housing, Dormitory Outright in OR, INS
Parking lot Outright in R3, UR, OR, AC, HC, I, RM, CBD, INS & P
Storage, Explosives Industrial District by Administrative Permit
Section 4. Amend SCC'~15.10.310 Conditional Use Permits. by inserting the following new
subsection E. and renumbering current subsections E. and F. as ~15.10310 F. and G. respectively.
E. Approval resolution. At any time after the hearing required in S 15.10.320 C., the
commission may adopt a resolution approving a conditional use permit provided that it includes
findings offact that the review criteria in S 15.10.320 D. have been met. Upon adoption, the city shall
cause a copy of the resolution to be posted for at least ten days in at least three public places within
the city. An appeal of the commission's action may be made at any time until the resolution becomes
effective. Unless rescinded, amended or appealed any resolution adopted under this chapter
automatically becomes effective ten days after passage and posting.
Section 5.
Amend SCC ~15.10.325 Variances. by inserting the following new subsection E.
and renumbering current subsections E. as ~15.10325 F.
E. Approval resolution. At any time after the hearing required in ~15.10.325 C.,
the commission may adopt a resolution approving a variance provided that it includes findings of fact
that the review criteria in 15.10.325 D have been met. Upon adoption, the city shall cause a copy of
the resolution to be posted for at least ten days in at least three public places within the city. An
appeal of the commission's action may be made at any time until the resolution becomes effective.
Unless rescinded, amended or appealed any resolution adopted under this chapter automatically
becomes effective ten days after passage and posting.
Section 6. Amend SCC ~16.01.015 Conditions to plat approval. by adding the following new
subsection:
F. A plat submitted to create a single parcel through the vacation of interior lot lines shall
be exempt from subsection C. Public Posting, D. Proof of posting and E. Notification of neighboring
property owners.

Section 7. This ordinance shall take effect ten (10) days following its enactment.
