RESOLUTION NO. 97-092
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, CONSENTING TO THE KENAI PENINSULA BOROUGH
PLANNING COMMISSION APPROVAL OF A PETITION TO V ACA TE
PUBLIC ACCESS EASEMENTS IN THE PRELIMINARY FOURTH OF
JULY CREEK SUBDIVISION
WHEREAS, the City of Seward is in the process of subdividing public lands identified
as USS's 4827,4828 and 3294, ASLS 76-69, Fourth of July Creek Tracts, ATS 1222 and Spring
Creek Correctional Facility Parcel A, along the east side of Resurrection Bay in what is known
as Nash Road, Fourth of July Creek Seward Marine Industrial Center areas; and
WHEREAS, at City of Seward request, the Alaska Department of Natural Resources
issued a Final Finding and Decision on January 24, 1994 to vacate, release, modify or relocate
public access easements within said lands in return for dedicating certain public right of ways and
providing certain alternate public access to adjacent public lands and Resurrection Bay; and
WHEREAS, the City of Seward petitioned the Kenai Peninsula Borough to vacate public
interest in various public access easements within the preliminary Fourth of July Creek
Subdivision
WHEREAS, said easements are unnecessary or conflict with industrial development and
are being replaced by a new plat with dedicated public roads and new or relocated easements; and
WHEREAS, the Seward Planning and Zoning Commission held a public hearing on the
petition at its May 7, 1997 meeting and recommended City Council consent of the approved
vacation; and
WHEREAS, at its June 9, 1997 meeting, the Kenai Peninsula Borough Planning
Commission approved the requested vacation; and
WHEREAS, in accordance with AS 29.40,140, no vacation of a city right of way or
easement may be made without the consent of the city council which has thirty (30) days from the
date of the borough decision to veto approval of the vacations;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, that:
Section 1. The City Council hereby consents to the Kenai Peninsula Borough Planning
Commission's approval of the petition to vacate public interest in a 100 foot wide right-of-way
easement described in the document recorded in Book 23 Page 867 in the Seward Recording

District. Said easement, located within USS 1651 extends from the northerly to the southerly
boundary of said U,S, Survey.
Section 2. The City Council hereby consents to the Kenai Peninsula Borough Planning
Commission's approval of the petition to vacate public interest in a 60 foot wide right of way
easement described in the document recorded in Book 36 Page 603 in the Seward Recording
District. Said easement extends from the centerline of Nash Road easterly to the westerly
boundary of Tract E, Fourth of July Creek Tracts.
Section 3. The City Council hereby consents to the Kenai Peninsula Borough Planning
Commission's approval to vacate, release, modify or relocate public access easements as noted
in the State of Alaska Department of Natural Resources Division of Land Final Finding and
Decision of January 24, 1994 on lands described within USS's 4827,4828, 3294 and ASLS 76-
69,
Section 4. This resolution shall take effect immediately upon its adoption,
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 23
day of June, 1997.
