RESOLUTION NO. 97-137
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AUTHORIZING THE CITY MANAGER TO EXECUTE A
TWENTY-YEAR LEASE WITH JACK AND SHEILA SCOBY DBA ORCA
ENTERPRISES FOR A PORTION OF BLOCK 6, OCEANVIEW
SUBDIVISION, DESCRIBED AS SEWARD SMALL BOAT HARBOR
BOARDWALK LEASE SITE NO. 10
WHEREAS, in order to ensure the continued use of valuable city-owned land in the harbor
area and to allow for local businesses' long-term planning, the City Council authorized the issuance
of a request for proposals for various sites along the boardwalk in the Small Boat Harbor; and
WHEREAS, in response to said request for proposals, Jack Scoby and Sheila Scoby, dba
Orca Enterprises, submitted a proposal to lease one site known as Site No, 10, and on November 12,
1996, the Council approved Resolution No. 96-144, awarding the Exclusive Right to Negotiate the
lease terms; and
WHEREAS, the City of Seward and Jack Scoby and Sheila Scoby, dba Orca Enterprises,
have concluded their negotiation of said lease agreement; and
WHEREAS, the lease rate for the subject property has been set at fair market value as
determined by recent appraisals in the Small Boat Harbor area;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The long-term lease (twenty years with two five-year extension options) of
approximately 3,770 square feet of city property preliminarily described as a portion of Block 6,
Oceanview Subdivision, and more commonly known as Boardwalk Site No. 10, within the City
of Seward, State of Alaska, to Jack Scoby and Sheila Scoby, dba Orca Enterprises, for the
development and operation of a fish processing/retail facility, is hereby APPROVED.
Section 2. The lease shall become effective upon the effective date of the Resolution and
shall run through September 23, 2017; the rental rate for the leased property shall be assessed at
$1.00 per square foot until June 30, 2000, or the next rental adjustment date. Any sublease of
the Leased Land must receive the prior written consent of the City.

Section 3 The City Manager is hereby authorized and instructed to execute the lease
agreement on behalf of the City on the date it becomes effective.
Section 4. This resolution shall take effect thirty (30) days after passage and posting as
required by law.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 25 day
of August, 1997.
