CITY OF SEWARD, ALASKA
RESOLUTION NO. 97-193
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, CALLING FOR A SPECIAL ELECTION TO BE HELD ON
JANUARY 20, 1998 FOR THE PURPOSE OF SUBMISSION TO THE
QUALIFIED VOTERS OF SEWARD THE QUESTION OF REPEAL OF
ORDINANCE 97-19
WHEREAS, the City Council adopted Ordinance No. 97-19 on July 14, 1997; and
WHEREAS, Ordinance No. 97-19 amends the Seward City Code Chapter 5.35, Sales Tax,
increasing the sales tax to four percent for the period April I to September 30, inclusive, for a period
of three years effective April I , 1998; and
WHEREAS, a referendum petition was issued by the City Clerk on August 22,1997; and
WHEREAS, the referendum petition was returned and then certified as sufficient on
December 1, 1997; and
WHEREAS, ~4.15.050 of the Seward City Code requires that the City Council either repeal
Ordinance No. 97-19 or set an election within 75 days of a certified petition being submitted to the
City Council; and
WHEREAS, the City Council supports this referendum petition issue going to a special
election rather than a repeal of Ordinance No. 97-19; and
WHEREAS, Tuesday, January 20, 1998 is within 75 days ofthe petition being submitted
to the City Council;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Clerk is hereby directed to set a special election of the City of Seward
to be conducted on January 20, 1998 in accordance with Seward City Code and Charter provisions
for the calling of special elections for the purpose of submission to the qualified voters of Seward
the question of repeal of Ordinance No, 97-19.

Section 2. The question ofrepealing Ordinance No. 97-19 shall be in substantially the
following form:
Repeal of Ordinance No. 97-19
Shall Ordinance No. 97-19, which amends the Seward City Code Chapter 5.35,
Sales Tax, increasing the sales tax to four percent for the period April 1 to September
30, inclusive, for a period of three years effective April 1, 1998, be repealed?
A "YES" vote supports repeal of Ordinance No. 97-19.
A "NO" vote opposes repeal of Ordinance No. 97-19.
Section 3. The City Clerk is further directed to seek expedited preclearance of the special
election date from the U.S. Department of Justice as required by the Federal Voting Rights Act of
1972.
Section 4. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 8th day
of December, 1997.
