CITY OF SEWARD, ALASKA
RESOLUTION NO. 90-061
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, SETTING RATES AND CHARGES
FOR SEWER SERVICES COMMENCING JULY 1, 1990
WHEREAS, Section 14.01.040 of the Seward City Code requires
that sewer rates and charges be fixed by resolution; and
WHEREAS, the city of Seward established rates for Sewer use
by adopting Resolutions No. 84-69 and No. 89-047; and
WHEREAS, except for certain industrial activities, the
quantity of sewage generated by a source is nearly equal to the
quantity of water consumed; and
WHEREAS, the current organization of sewer rates is difficult
to use, has not been inventoried and does not enable charging
according to the quantity of sewage generated; and
WHEREAS, a water rate study completed in 1989 determined water
rates based on average water consumption by activities for
nonmetered services, and such services have been inventoried; and
WHEREAS, the Sewer utility has found it necessary to borrow
from the general fund to pay the cost of minimum essential
services, operations and maintenance of the utility;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. Resolutions No. 84-69 and No. 89-047 are hereby
REPEALED.
Section 2. The following rate structure, attached and
incorporated herein by reference, is hereby ADOPTED:
GROUP A - RESIDENTIAL
GROUP B - SMALL GENERAL SERVICE
GROUP C - LARGE GENERAL SERVICE
GROUP D - METERED COMMERCIAL & INDUSTRIAL SERVICE
GROUP E - SPECIAL RATES AND FEES
Section 3. This resolution shall take effect jULY 1, 1990.
PASSED AND APPROVED by the City Council of the city of Seward,
Alaska, this 11th day of June, 1990.

SECTION I - NONMETERED SERVICES
Nonmetered sewer users in Groups A, Band C shall be charged at the
rate of 1.2 times their total water charge, not including tax, when
the water service and sewage service serve the same activities.
If the activities serviced by the sewer service are different than
those served by water, a water charge shall be computed based on
the activities served by the sewer, and the sewer rate shall be 1.2
times the computed water charge.
SECTION II - METERED SERVICES
Users with metered service (Group D) shall be charged for sewer
service according to the rates listed below. The charge shall be
based upon the quantity of metered water, except that those users
having a sewer meter shall be charge for the quantity of sewage
actually metered. The quantity of sewage will be adjusted if a
significant amount of waste water is not discharged into the city
sewer system.

SECTION III - GROUP E, SPECIAL RATES, FEES & CONDITIONS

A user generating sewage with a BOD and SS loading
in excess of 250 mg/l, upon a determination by the
utility manager that the concentration and charac-
teristics of the sewage shall not cause a detrimen-

tal effect upon the sewer system and/or treatment
plant, shall pay the specified rate times a factor
of the actual BOD and SS loading divided by 250,
plus the cost of testing.
2. Tank truck operators. The fee to discharge fresh
sewage, or waste from portable or chemical toilets,
providing the utility manager determines the
concentration and characteristics of the sewage will
not cause a detrimental effect upon the sewer system
and/or treatment plant, shall be $30.00 per thousand
gallons. It is prohibited to discharge into the
city's sewer system septic tank waste or any waste
containing toxic or other materials that could cause
the city's discharge to violate the EPA or DEe
discharge permit.
3.
Recreational vehicles. There is no fee charged
vehicle operators to discharge privately owned
recreation vehicles into city-owned or approved dump
sites. Public and private campground operators
shall pay $0.50 per day for each RV, camper or
trailer permit, not including tent campers, for the
cost of sewer service. The campground operator
shall maintain sufficient records to compute a
monthly payment, and such records shall be made
available to the city upon request.
4. Ships' Sewage. Not accepted
5. Sewer Service Connection Fee. Sewer service
connections shall be installed by property owners
at their own expense. Any work done by the city
will be charged at total cost, including labor,
overhead, administration, materials and equipment.
6. Sewer service inspection fee. A $150.00 inspection
fee shall be charged for services installed by
anyone other than the city.
7. Unauthorized connection or discharge into the city
sewer svstem. A fee of $500.00 for each occurrence,
in addition to all costs of repair, restoration or
cleanup by the city, plus state and/or federal
penalties and charges levied against the city or
individual, shall be charged for such occurrence.
8.
Restoration of sewer service and repair of damage
by owner or contractor to citv facilities. The

9. Locate service. There shall be no charge for the
first locate; thereafter, $50.00 shall be charged
for each additional locate. Large projects requir-
ing several locates will be under a special contract
with the Sewer Utility and may require a fee.
10. Security deposit. No additional security deposit
will be required if a water security deposit has
been paid. If no water security deposit has been
paid, the following deposits shall be required:

11. Contractor work. Any contractor tapping into a city
sewer main, or otherwise working on a city sewer
main, must be properly licensed to perform the work
and must also provide a $5,000 bond or equivalent
cash guarantee payable to the city.
12. Sewage meter. Metered sewage will be computed from
the quantity of metered water delivered to the same
activity, except if a sewage meter has been in-
stalled. A sewage meter approved by the city may
be installed at the user's expense.
