RESOLUTION NO. 90-131
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, APPROVING A CITY PERSONNEL
POLICY REGARDING SEXUAL HARASSMENT
WHEREAS, complaints involving sexual harassment constitute the
largest number of employment claims presented to the Equal
Employment Opportunity Commission (EEOC); and
WHEREAS, the EEOC has issued guidelines and definitions of
sexual harassment in the work place; and
WHEREAS, it is in the public interest for the city to formally
adopt these guidelines as a part of the city's personnel policy;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:

PERSONNEL POLICY REGARDING SEXUAL HARRASSMENT
Sexual harrassment in the workplace is unacceptable conduct and will not be
tolerated or condoned. Sexual harrassment includes unwelcome sexual advances,
requests for sexual favors and other verbal or physical conduct of a sexual nature.
Sexual harrassment will be regarded as a violation of this policy when:
(1) submission to such conduct is made a condition of employment, or
(2) submission to or rejection of such conduct is used as the basis for employment-
related decisions such as promotion, performance evaluation, pay adjustment, discipline,
work assignment, etc, or
(3) such conduct otherwise interferes with work performance or creates an
intimidating, hostile or offensive working environment.
All complaints of sexual harrassment will be promptly and thoroughly investigated,
and violations of the policy will be treated as serious disciplinary infractions. All
complaints of sexual harrassment will be confidential, and only those persons necessary
for the investigation and resolution of the complaint will be given information about it.
Complaints shall be presented in accordance with the established procedures in
city codes, Title 3, Personnel, Chapter 3.40, unless the supervisory personnel detailed in
the process are directly involved in the complaint. In any case, an employee may present
the complaint directly to the Personnel Officer should this present a more comfortable
situation to the employee.
