CITY OF SEWARD, ALASKA
RESOLUTION NO. 91-124
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, DECLARING A STATE OF DISASTER
RELEVANT TO THE FAILURE OF THE LOWELL POINT SEWAGE
TREATMENT LAGOON AND SEEKING BOROUGH, STATE AND
FEDERAL ASSISTANCE
WHEREAS, on August 26, 1991, the city of Seward's Sewage
Treatment Lagoon located on Lowell Point Road suffered a cata-
strophic failure; and
WHEREAS, as a result of this failure, the city of Seward has
expended to date in excess of $50,000 of unbudgeted personnel,
pumping and other costs including water well testing and profes-
sional services and the provision of drinking water to area
residents in order to protect the public health and welfare; and
WHEREAS, the cause of the treatment plant failure has not yet
been determined; and
WHEREAS, it is anticipated that the cost of dealing with this
disaster will continue to escalate and will include additional
personnel, pumping and alternative disposal costs; professional
services to determine the cause of the failure; drafting and
implementing a plan to repair and/or remodel the structure; and
continued monitoring of domestic well water to assure the safety of
area residents; and
WHEREAS, the city of Seward wishes to seek borough, state and
federal funding and other assistance to aid in the resolution of
this situation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. A State of Disaster Emergency is hereby declared
to exist in the city of Seward.
Section 2. It is requested that the Governor declare a
Disaster Emergency to exist as provided for in AS 26.23 and provide
such assistance as is requested and/or request additional assis-
tance from the President or appropriate federal agencies where
state capability is not adequate.
Section 3. It is further requested that the Kenai Peninsula
Borough Mayor join the city of Seward in this Declaration of
Disaster Emergency and that the Borough commit such funds and other

assistance as are available to assist in the city's response to
this disaster.
Section 4. The City Council hereby certifies that the city of
Seward has or will expend resources as a result of this disaster
for which no state or federal reimbursement will be requested and,
this constitutes a substantial expenditure on the part of the city
of Seward.
Section 5. This resolution shall take effect immediately upon
its adoption.
PASSED AND APPROVED by the City Council of the city of Seward,
Alaska, this 23rd day of September, 1991.
