HomeMy WebLinkAboutRes1990-001 Sponsored by: Schaefermever CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 90-001 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A REQUEST FOR CONDITIONAL USE PERMIT TO JIM AND RHONDA HUBBARD FOR A GUEST HOUSE WITHIN AN ATTACHED GARAGE ON LOTS 28 AND 29 BLOCK 3 JESSE LEE HEIGHTS SUBDIVISION AS AUTHORIZED BY SECTION 15.10.320 OF THE SEWARD ZONING CODE WHEREAS, Jim and Rhonda Hubbard have requested a Conditional Use Permit to allow a guest house on Lots 28 and 29, Block 3, Jesse Lee Heights Subdivision, as part of a garage attached by a breezeway to a proposed single family dwelling; and WHEREAS, an application meeting the requirements of Section 15.10.320(B), except a dimensioned plot plan, was submitted and received on November 14, 1990; and WHEREAS, this request is located on land zoned Single Family Residential (R1); and WHEREAS, a duly requirements of Section on December 5, 1990; advertised public hearing, meeting the 15.01.040, has been held by the Commission NOW, THEREFORE, BE IT RESOLVED BY THE SEWARD PLANNING AND ZONING COMMISSION of the City of Seward that: Section 1. The proposed use satisfies the conditions specified in Section 15.10.320(D). Section 2. The City Clerk is authorized to issue a Conditional Use Permit to Jim and Rhonda Hubbard for a guest house within a garage attached by a breezeway to a single family residence on Lots 28 and 29, Block 3, Jesse Lee Height Subdivision, subject to the following specific conditions: 1) The interior property line must be vacated to create a single lot. 2) The guest house may not exceed 600 SF ln size and may not be rented out. 3) The applicant must present the final building plans to the P&Z Commission for review and approval prior to a building permit being issued. 4) The garage/guest house may not exceed 20 feet in height. 1 P.O. The interior property line must be vacated to create a single lot. 2. The guest house may not exceed 600 square feet in size and may not be rented out. 3. The applicant must present the final building plans to the Planning and Zoning Commission for approval prior to a building permit being issued. 4. The garage/guest house may not exceed twenty feet in height. 5. A total of four (4) off street parking places are provided for the house and the guest house. An approved conditional use permit lapses six (6) months after approval if no building permit is procured or if the allowed uses are not initiated. The Seward Planning and Zoning Commission may grant time extensions not to exceed six (6) months upon a finding that circumstances have not changed sufficiently to warrant reconsideration of the approval of the conditional use permit. A public hearing shall not be required prior to granting an extension of time (Section IS.10.320(E), Seward Planning and Land Use Regulations). Failure to adhere to all the conditions of this permit may result in revocation of the permit and possible civil and criminal penalties.
