RESOLUTION NO. 92-003
A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION,
ALASKA, GRANTING A REQUEST FOR CONDITIONAL USE PERMIT BY ALASKA
DOT/PF FOR EXTRACTION AND TRANSPORTATION OF GRAVEL FROM JAP CREEK
WITHIN SE1/4 SECTION 28 T1N R12 SM AS AUTHORIZED BY ~15.10.320 OF
THE SEWARD ZONING CODE
WHEREAS, the Alaska Department of Transportation and Public
Facilities (DOT/PF) has requested a Conditional Use Permit for the
extraction and transportation of gravel from their material source
at Jap Creek through Forest Acres Subdivision to the Seward
Airport; and
WHEREAS, an application meeting the requirements of Section
15.10.320(B) was submitted and received on January 15, 1992; and
WHEREAS, this request is located on land zoned Resource
Management; and
WHEREAS, a duly advertised public hearing, meeting the
requirements of Section 15.01.040, has been held by the Commission
on February 5, 1992.
NOW, THEREFORE, BE IT RESOLVED BY THE SEWARD PLANNING AND ZONING
COMMISSION of the City of Seward that:
Section 1. The proposed use satisfies the conditions specified
in Section 15.10.320(D) of the Seward Zoning Code.
Section 2. The City Clerk is authorized to issue a Conditional
Use Permit to the Alaska Department of Transportation and Public
Facilities for the extraction of ~40,OOO cubic yards of gravel from
DOT/PF MS No. 31-1-606-1 and transport of same over public streets
subject to the following conditions:
1. Because of spring breakup and the residential
construction standards of the road, load limits will be
the same as those in effect on the state highway.
2. Flag persons will be used at a designated school crossing
intersection during the hours of 7:30 a.m. to 8:30 a.m.
and 3:00 p.m. to 4:00 p.m.
3. Representatives of the City and DOT/PF will inspect and
document the haul route prior to and immediately after
the hauling operation. DOT/PF will repair any damage
created by the hauling operation up to and including
overlay and rebuilding if necessary.
