HomeMy WebLinkAboutRes1992-010 Sponsored by Schaefermeyer CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 92-010 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, APPROVING A VARIANCE REQUEST BY STIRRAT AND JEAN CLARK AND DALE LINDSEY TO ALLOW FOR CONSTRUCTION OF A SINGLE FAMILY RESIDENCE ON A NON-CONFORMING PARCEL CONSISTING OF LOTS 5A AND 6A, PARK PLACE SUBDIVISION WHEREAS, upon purchase from Dale Lindsey of Lots SA and 6A, Park Place Subdivision, the applicants, Stirrat and Jean Clark, propose to construct a single family residence; and WHEREAS, except for overall lot size and buildable area, the proposed use meets setback development requirements of the zoning code; and WHEREAS, the proposed use is consistent with the purpose of this chapter and the purposes of the multi-family zoning district; and WHEREAS, the value of adjoining property will not be significantly impaired by the proposed use; and WHEREAS, the proposed use is in harmony with the Seward Comprehensive Plan for this area of town; and WHEREAS, public services and facilities are adequate to serve the proposed site; and WHEREAS, the proposed use will not be harmful to the public safety, health or welfare; and WHEREAS, the combination of the original platting and the topographical features of the property create special conditions and circumstances which are peculiar to the land which are not applicable to other lands in the same R3 district within the community; and WHEREAS, the special topographical and platting conditions and circumstances have not been caused by actions of the applicant; and WHEREAS, financial hardship or inconvenience is not the reason for granting the requested variance; and Seward Planning and Zoning Commission Resolution No. 92-010 WHEREAS, no other nonconforming land uses within the district have been considered as grounds for granting the requested variance; and WHEREAS, the request to allow construction on less than the required total buildable area is the minimum variance necessary to permit the reasonable use of the land; and WHEREAS, the variance requested will not permit a land use in the R3 district which is otherwise prohibited; and WHEREAS, a public hearing, required by law, was conducted by the Commission on June 3, 1992. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The Commission finds that the applicants have met all of the conditions set forth in Sections 15.10.320 D and 15.10.325 of the Seward City code. Section 2. The City Clerk is authorized to issue a variance permit to Dale Lindsey as property owner and Stirrat and Jean Clark as purchasers/developers for the construction of a single family residence on Lots 5A and 6A Park Place Subdivision, subject to all the requirements of Table 15.10.220 Development Requirements with the exception of minimum buildable lot size, and further subject to having the" two lots combined into a single lot by vacating interior lot lines Section 3. The interior lot lines of Lots 5A and 6A, Park Place Subdivision, shall be vacated creating as large a single lot as possible. Section 4. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 3rd day of June, 1992. TH...
