PLANNING AND ZONING COMMISSION
RESOLUTION NO. 93-004
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING A CONDITIONAL USE PERMIT TO CANDACE
AND CARL NORMAN FOR AN OFF-SITE/OFF-STREET PARKING LOT
TO BE CONSTRUCTED ON LOTS 29 & 30, BLOCK 8, ORIGINAL TOWNSITE
TO BE USED AS EMPLOYEE PARKING FOR A PROPOSED
HOTEURESTAURANT LOCATED AT 221 BALLAINE BOULEVARD,
AS AUTHORIZED BY ~ 15.10.215(E) OF THE SEWARD ZONING CODE
WHEREAS, an application, which meets the requirements of Section 15.10.320(B),
has been submitted by Carl and Candace Norman for a Conditional Use Permit to allow
for an off-site/off-street parking lot in association with a proposed hotel and restaurant
complex to be developed at 221 Ballaine Boulevard; and
WHEREAS, in support of required on-site parking requirements, if it is found to
be impractical to provide such parking on site, it may be located on property within 300
feet of the primary use; and
WHEREAS, the proposed parking lot is allowed by Conditional Use Permit within
the Central Business District; and
WHEREAS, a duly advertised public hearing, meeting the requirements of Section
15.01.040 of the City Code was held by the Commission on March 10, 1993;
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The proposed use is found to satisfy the conditions specified in Section
15.10.320(0) of the Seward City Code.
Section 2. The city clerk is authorized to issue a Conditional Use Permit to
Candace and Carl Norman for an off-site/off-street parking lot at 216 Fifth Avenue on
Lots 29 and 30, Block 8, Original Townsite subject to:
a) approval by the City Council of an ordinance amendment modifying the
maximum 300 foot allowed distance specified in ~ 15.10.215(E);
b) a written agreement that will be recorded to dedicate Lots 29 and 30, Block
8, Original Townsite, as exclusive parking for the proposed Sea Inn
Seward Planning and Zoning Commission

Hotel/Harbor Dinner Club restaurant complex at 221 Ballaine Boulevard
for the life of the hotel/restaurant unless parking code requirements are
otherwise modified;
c) design of the lot in accordance with ~ 10.10.215(H) to include:
1) a gravel or paved surface
2) a four to six foot hedge or fence separating the lot from the neighboring
residential property; and
d) a scaled, engineered parking lot design showing grades, drainage, surfacing, space
layout, curb cuts and re-striping of 5th Avenue parking spaces will be submitted
to the city engineer for approval prior to construction.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this
10th day of March, 1993.
