RESOLUTION NO. 94-019
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, AMENDING THE CONDITIONAL USE PERMIT
ISSUED TO THE SEWARD ASSOCIATION FOR THE ADVANCEMENT
OF MARINE SCIENCE ON AUGUST 3RD FOR A MARINE RESEARCH
AND PUBLIC EDUCATION FACILIlY
WHEREAS, the Seward Association for the Advancement of Marine Science
(SAAMS) requested a Conditional Use Permit for the operation of a marine research and
public education facility on what is currently identified as Seward Waterfront Tracts 2-6, the
public dock and access road and an associated off-site employee parking lot on Block SA
Oceanview Subdivision Addition No.1; and
WHEREAS, Resolution No. 94-017, granting the permit, was approved by the
Planning and Zoning Commission on August 3, 1994; and
WHEREAS, the permit included 17 conditions, and Condition No. 17 required
SAAMS to locate and develop suitable off-site parking and return former Tracts Sand 6 to
the city of Seward within 10 years; and
WHEREAS, Title 7 of the Seward City Code vests the power to acquire and dispose
of real property interests solely with the City Council; and
WHEREAS, the Planning and Zoning Commission unintentionally placed acquisition
and disposal limitations on real property as described in Condition No. 17 of the CUP;
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The City Clerk is hereby authorized to amend the Conditional Use Permit
by deleting Condition No. 17.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 7th
day of September, 1994.
