RESOLUTION NO. 26=1S
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING AN AMENDED CONDITIONAL USE PERMIT TO BRAD
SNOWDEN FOR THE DEVELOPMENT AND OPERATION OF A HOTEL AT 1412
FOURTH AVENUE IN THE SMALL BOAT HARBOR
WHEREAS, on June 3, 1993, Brad Snowden was granted a Conditional Use Permit to
develop and operate a hotel on Alaska Railroad lease property in the Small Boat Harbor; and
WHEREAS, on September 1, 1993, the Commission approved Resolution No. 93-13,
which amended the Conditional Use Permit by adding specific conditions regarding the proposed
relocation of Fourth Avenue to accommodate the proposed project; and
WHEREAS, on August 30, 1996, Mr. Snowden submitted an updated site plan, which
identified the proposed Fourth A venue realignment and project footprint; and
WHEREAS, since some of the conditions of the permit are no longer applicable, there is
a need to update the Conditional Use Permit in order to clarify what project conditions must still
be adhered to.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. Based on the Findings of Fact addressed in the associated agenda statement,
the City Clerk is hereby authorized to issue an amended Conditional Use Permit to Brad Snowden
for the development and operation of a hotel on Alaska Railroad property within the Seward Small
Boat Harbor subject to the following conditions:
1. In accordance with the Harbor Master Plan, permittee must construct, to city
standards, an extension of the public boardwalk along the shoreline of his lease property.
2. The permittee may relocate the existing Fourth Avenue right-of-way in order to
accommodate the proposed development project subject to the following requirements:
a. The city will cooperate with the applicant regarding the road relocation but will
oppose any proposals to eliminate the Fourth Avenue access to Port Avenue.
b. The design of the proposed Fourth Avenue road relocation shall be approved
by the city.
c. All costs involved in designing, relocating and paving Fourth Avenue will be
at other than city expense.

d. The permittee shall be required to relocate or replace any public facilities/public
utilities which are directly impacted by the proposed Fourth A venue road relocation in
accordance with a development agreement between the city and the developer.

occupancy.
6. A final site plan incorporating all identified conditions will be submitted to the city
for review as part of the building permit application.
Section 2. This resolution shall supersede Seward Planning and Zoning Commission
Resolution No. 93-12 and Resolution No. 93-13.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 4th
day of September, 1996.
