RESOLUTION NO. 26.:J1
A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION,
GRANTING A CONDITIONAL USE PERMIT TO PROVIDENCE HEALTH SYSTEMS
FOR THE CONSTRUCTION AND OPERATION OF PROVIDENCE SEWARD
MEDICAL CENTER ON LOTS 1, 2, 3,13,14,15,16,17 and 18, MARATHON
ADDITION AS AUTHORIZED BY 15.10.320 OF THE SEWARD ZONING CODE
WHEREAS, Providence Health Systems and ECI/Hyer Inc. requested a Conditional Use
Permit for the construction and operation of Providence Seward Medical Center on Lots 1, 2, 3,
13, 14, 15, 16, 17 and 18, Marathon Addition; and
WHEREAS, an application meeting the requirements of Section 15. 10. 320(B), was
submitted and received on September 12, 1996; and
WHEREAS, this request is located on land zoned Institutional; and
WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), a hospital
is permitted within the Institutional Zoning District by Conditional Use Permit; and
WHEREAS, a duly advertised public hearing, meeting the requirements of Section
15.01.040 was held by the Commission on October 2, 1996.
NOW, THEREFORE, BE IT RESOLVED BY THE SEWARD PLANNING AND
ZONING COMMISSION of the City of Seward that:
Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning Commission
has reviewed the applicant's request for a Conditional Use Permit (CUP) to construct and operate
a medical center on Lots 1, 2, 3, 13, 14, 15, 16, 17 and 18, Marathon Addition and made the
following Findings of Fact:
A. A completed application and fee was submitted. The application and $250.00 fee was
received by the city on September 12, 1996
B. The use is consistent with the purpose of this chapter and the purposes of the zoning
district, to wit:

1. Designating, regulating and restricting the location and use of buildings, structures
and land for residence, commerce, trade, industry or other purpose. The
proposed site is zoned Institutional (INS). Development standards in the INS
district are intended to set a high standard to assure that the activities provide
visual amenity to the surrounding area. A hospital is allowed within the INS
District by Conditional Use Permit.
2. Regulating and limiting the height, number of stories and size of buildings and
other structures hereinafter erected, or alterations of existing buildings. The
proposed hospital meets all of the development requirements of the INS
District including building height, setbacks and lot coverage.
3. Regulating and determining the size of yards and other open spaces in order to
provide adequate open space for light and air, and to prevent and fight fires. The
INS District requires the following setbacks: front = 20 ft; rear = 15 ft; side
= 10; & side adjacent to a street = 10. The development proposal meets all
of the required setbacks.
4. Regulating and limiting the density of population by preventing an undue
concentration of population. It does not appear that the proposed development
will increase the permanent resident population in the area surrounding the
project or community wide.
5. Lessening congestion on streets and highways. The project plans identify a public
entrance/exit off of First Avenue and an ambulance entrance and separate exit
on Lowell Canyon Road. The site plan identifies a greater number of public
and employee parking spaces for the proposed hospital than what is required
by the Zoning Code.
C. The value of adjoining property will not be significantly impaired. Because the proposed
development will be replacing an existing use on the property, there is no evidence
that the project would have any significant negative impact on adjoining property nor
would it make any change in property values community wide.
D. The proposed use is in harmony with the Seward Comprehensive Plan. The
Comprehensive Plan states the following:

Community; Provide Health Care Facilities Which Meet Critical Building, Fire and
Life Safety Code Requirements; and Meet the Demands for New Technologies In
Therapeutic and Laboratory Equipment
'*' The Need Exists to Enhance Emergency and Critical Care Transportation
Services To Ensure Essential Transport Services for Patients Needing Health Care
Facilities Outside Seward... Examine the feasibility of developing a helicopter landing
facility in proximity to the hospital
E. Public Services and facilities are adequate to serve the proposed site. Adequate water,
sewer and power appear to be available to the property as well as adequate fIre, police
and solid waste disposal services. According to the 2010 Comprehensive Plan,
"Curbs, Gutters and Sidewalks are Needed Throughout the Community." There is
a public need for sidewalks in the area of the proposed facility to ensure that
pedestrians have a safe place to walk. Sidewalks would deter pedestrians from
walking in the paved roadway where the emergency vehicles will be traveling.
F. The proposed use will not be harmful to the public safety, health or welfare. There is
concern that planting trees in the city right-of-way would impede emergency exit
visibility and prohibit the construction of a sidewalk along the north side of the Lowell
Canyon Road right-of-way.
G. Any and all specific conditions deemed necessary by the commission to fulfill the above-
mentioned conditions shall be met by the applicant. These may include but are not limited
to measures relative to access, screening, site development, building design, operation of
the use and other similar aspects to the proposed use (See Section 2).
Section 2. Based on the Findings of Fact specified in Section 1, the Planning and
Zoning Commission authorizes the City Clerk to issue a Conditional Use Permit to Providence
Health Systems for the construction and operation of a hospital on Lots 1, 2, 3, 13, 14, 15, 16,
17 and 18, Marathon Addition, subject to the following conditions:
1. Any significant plan amendments or future expansion/development plans (i.e.
medivac helipad, future building) will be submitted to the P&Z Commission for
further review, approval and possible conditions.
2. An informational and directional sign plan will developed and approved by the
Commission.

3. All parking areas and driveways will be paved within one year from the demolition
of the existing hospital.
4. In accordance with Seward City Code ~ 15.10.215 (H), lighting of all parking
areas shall be developed to reflect away from adjacent residential areas and all
public streets.
5. If, at any time, the vegetative screening between Glacier View Apartments and the
hospital property is removed it must be replaced by either a solid wood fence or
hedge not less than four feet or more than six feet in height.
6. The site plan will be amended in accordance with SCC ~ 15.10.215 (N) which
prohibits any fence, wall, hedge, or other planting, structure or vehicle, forming
a material impediment to visibility, within the required site distance triangle.
7. Landscaping, based on the plan submitted with the Conditional Use Permit
application, shall be completed within one year from the date of the certificate of
occupancy, with the exception that trees will not be permitted within the public
right-of-way.
8. Solid waste dumpster(s) will be screened from public view with a solid wood
fence.
9. The permittee will submit final grade elevation plans and a drainage plan to the city
for review and approval.
Section 3. This resolution shall take effect immediately upon its adoption.
