PLANNING AND ZONING COMMISSION
RESOLUTION NO. 26:ll
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, PROVIDING A DECLARATORY RULING REGARDING OFF-
STREET PARKING FOR THE NONCONFORMING LOT AND STRUCTURE LOCATED
AT 608 ADAMS STREET ON LOT 20, BLOCK 18, ORIGINAL TOWNSITE OF SEWARD
WHEREAS, the Original Townsite of Seward was established prior to the adoption of the
first local zoning ordinance; and
WHEREAS, property tax records identify that the structure located at 608 Adams Street
on Lot 20, Block 18, Original Townsite of Seward, existed on the lot prior to the adoption of the
first local zoning ordinance in 1956; and
WHEREAS, according to Seward City Code ~ 15.10.315 (Nonconforming lots, structures
and uses), Lot 20, Block 18, Original Townsite of Seward, is nonconforming and the structure
located on the lot is also nonconforming; and
WHEREAS, it appears that there is no reasonable use of the lot that can meet the off-street
parking requirements of the Seward Zoning Code.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. Provided no adjacent platted lots are in the same ownership, any future use of
Lot 20, Block 18, Original Townsite of Seward shall be limited to a use which requires no more
than four off-street parking spaces, according to the Seward Zoning Code.
Section 2. Provided that the existing structure is not destroyed or removed, any future use
of the property, must develop the vacant space on the east side of the property for off-street
parking.
Section 3. The existing structure shall not be enlarged or altered in a way which increases
its nonconformity (SCC ~ 15.10.315 F,I)
Section 4. If the existing structure is destroyed or removed, the lot may only be developed
as a single-family residence provided that all other code conditions are met; and no adjacent
platted lots are in the same ownership (SCC ~ 15.10.220 Development Requirements, Note 2, D).
Section 5. All other requirements and limits set forth in the Seward Zoning Code shall
be adhered to.

Section 6. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 10th
day of December, 1996.
