A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, AMENDING THE CONDITIONAL USE PERMIT ISS TO BRAD
SNOWDEN FOR DEVELOPMENT AND OPERATION OF A HOTEL N ALASKA
RAILROAD RIGHT OF WAY WITHIN THE SMALL BOAT ARBOR

WHEREAS, Mr. Brad Snowden was granted a Conditional Uss(Permit (CUP) through
Resolutions 93-012 and 93-013 to develop and operate a hotel complex/on Alaska Railroad Right
of Way property within the Seward Small Boat Harbor area; and /

WHEREAS, Mr. Snowden was subsequently grantjtd extensions to the permit by
Resolutions 94-006,94-020 and 95-010 through October 5,/1'995; and
,
WHEREAS, Mr. Snowden has entered into a IIl,l1tual responsibilities agreement with the
City regarding the relocation of utilities, roads, parking, and the RV dump station; and
WHEREAS, Mr. Snowden has requested that the permit conditions relating to his bearing
the expense of the 4th A venue and RV dump station relocation as well as the construction of the

boardwalk be deleted and that the city bear Jhe cost of those public facility projects.
NOW, THEREFORE,

BE IYRESOLVED by the Seward Planning and Zoning

Section 1. Section 2 of lu i n - 12, authorizing a Conditional Use Permit to Mr.
Brad Snowden for developme t and operation of a hotel complex in the Harbor Commercial
District of the Seward Smal oat Harbor area is hereby amended as follows:
a) A more detai d dimensioned site plan, coordinated with the city and railroad will be
submitted to the Co Ission for further review, comments and possible conditions. The plan must
show:
( specific street and sidewalk realignment
2) impact on passenger rail spur length
(3) utility relocation
(4) property boundaries
(5) associated tideland development
(6) public parking spaces lost
(7) parking areas created
(8) specific easement location for public restrooms
(9) boardwalk/sidewalk route

c) The city will cooperate with applicant regarding the relocatioll of 4th Avenue but will
oppose any proposals to eliminate the 4th Ave access to Port A venue.

Section 2. R I i-I , Section 1, adding conditions to the Conditional Use
Permit issued to Mr. Brad Snowde for development and operation of a hotel complex in the
Harbor Commercial District of the eward Small Boat Harbor area is hereby amended as follows:
1) A fmal site plan in rporating all identified conditions will be submitted to the City for
review as part of the build' g permit application.
2) 4th Ave rig of way to be realigned in such a manner as to skirt the north side of the
sewer pump station d intersect a right of way extending from 3rd Ave along the property line
of Lot 1 Block 1 orth Harbor Subdivision (NAPA property) around to Port Ave.
3) T construction relocation of 4th Avenue must take place after September 15th and
before Ma 15th.
~) Permittee will provide enough paved, striped public parking spaces to replace those lost
duri g relocation of 4th Ave to maintain a total of 148 spaces.

6) It is understood that because of ground temperatures and av;ilability of asphalt
contractors, paving may take place after the summer tourist season begins; 96wever all paving will
be completed prior to September 15, 1994. /

7) The railroad passenger shelter and its associated bus lo~i~g zone must be located in
such a manner that passengers are not required to cross a street.t6 access the bus loading area.
Section 3. This resolution shall take effect immedia,tely upon its adoption.
