HomeMy WebLinkAboutRes1995-006 Sponsored by Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 2S:!l6 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION, GRANTING A SIX MONTH EXTENSION OF THE CONDITIONAL USE PERMIT ISSUED TO THE SEWARD ASSOCIATION FOR THE ADVANCEMENT OF MARINE SCIENCE WHEREAS, the Seward Association for the Advancement of Marine Science (SAAMS) received a Conditional Use Permit (CUP) on September 23, 1994, for construction and operation of a marine research and public education facility on what is identified as Tract 2A on the preliminary plat of the Waterfront Tracts and an associated off-site parking lot on Block 5A Oceanview Subdivision Addition No.1; and WHEREAS, the Alaska SeaLife Center project has been moving forward with design development and is expected to break ground in May, 1995; and WHEREAS, SAAMS is currently working with the local building inspector to procure the required building permits; and WHEREAS, City of Seward agreements with SAAMS and the Alaska Department of Fish and Game are currently being negotiated to convey the $25 million from the Exxon Valdez Oil Spill Trustee Council through the city to SAAMS; and WHEREAS, SAAMS has requested a six-month extension to provide time to complete and obtain approval of the building design and begin construction of the facility; and WHEREAS, in accordance with SCC ~ 15.10.320 E., the Planning and Zoning Commission is authorized to grant extensions not to exceed six months each upon a finding that the circumstances have not changed sufficiently to warrant a reconsideration of the approval of the CUP; NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. The circumstances have not changed sufficiently to warrant a reconsideration of the approval of the CUP issued to SAAMS for development of a marine research and public education facility within the Waterfront Tracts of Seward. Section 2. A six month extension through September 1, 1995, of the amended CUP approved by the Seward City Council following the Board of Adjustment Hearing held on Seward Planning and Zoning Commission Resolution No. 95-06 September 19, 1994, is hereby granted to the Seward Association for the Advancement of Marine Science. Section 3. This resolution shall take effect immediately upon its adoption. PASSED AND APPROVED by the Seward Planning and Zoning Commission this 1st day of March, 1995.
