A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, APPROVING A LIMITED CONDITIONAL USE PERMIT TO
RICHARD LEWIS FOR OPERATION OF A SELF-CONTAINED FAST FOOD WAGON
ON LOT 3, BLOCK 7, OCEANVIEW SUBDIVISION THROUGH SEPTEMBER 30, 1995,
AS AUTHORIZED BY ~ 15.10.320 OF THE SEWARD ZONING CODE
WHEREAS, Richard Lewis submitted a request for a Conditional Use Permit to operate
a self-contained fast food wagon on Lot 3, Block 7, Oceanview Subdivision which is zoned Auto
Commercial; and
WHEREAS, transient merchants are allowed in the Auto Commercial District by
Conditional Use Permit; and
WHEREAS, an application meeting the requirements set forth in ~ 15.10.320 (B) of the
Seward Zoning Code was submitted and received on May 15, 1995; and
WHEREAS, a duly advertised public hearing, meeting the requirements set forth in ~
15.01.040 was held by the Planning and Zoning Commission on June 7, 1995.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The proposed use satisfies the conditions specified in ~ 15.10.320 (D) of the
Seward Zoning Code.
Section 2. The City Clerk is authorized to issue a Conditional Use Permit to Richard
Lewis for operation of a self-contained fast food wagon on Lot 3, Block 7, Oceanview Subdivision
for a period ending September 30, 1995, subject to the following conditions:
1. The permit expires on September 30, 1995.
2. The tires must be blocked and the bus fully skirted and painted to match the mobile
unit.
3. The covered deck attached to the bus shall be painted to match the mobile unit.
4. The operator will provide at least three (3) on-site parking spaces in conformance
with the requirement of the Seward Zoning Code.
5. The unit is to be totally self-contained and not "hard" connected to city utilities.

6. The operator shall maintain the site free of litter at all times through the use of on-
site covered trash receptacles and be responsible for disposing of the rubbish
accumulated in the receptacles in accordance with SCC ~ 14.05.
7. The operator is required to ensure that the mobile unit maintains at least a 10 foot
setback from any property line, building or other transient merchant or mobile
unit.
8. The business owner shall comply with the requirements of the local sign code
which prohibits portable and off-premise signs.
9. The operator shall ensure that all material and storage related to the transient
merchant operation will be removed from the City owned Lot 2, Block 7,
Oceanview Subdivision, adjacent to the proposed site.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 7th
day ofJune, 1995.
