RESOLUTION NO. 2S:.16
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING A VARIANCE TO THE SEWARD ASSOCIATION FOR
THE ADVANCEMENT OF MARINE SCIENCE (SAAMS) TO EXCEED MAXIMUM
BUILDING HEIGHT LIMITS FOR THE DEVELOPMENT OF THE ALASKA SEALIFE
CENTER ON TRACT 2A, SEWARD WATERFRONT TRACTS
WHEREAS, the Seward Association for the Advancement of Marine Science has
requested a Variance from the established maximum building height limits to facilitate the
construction of the Alaska SeaLife Center on Tract 2A, Seward Waterfront Tracts; and
WHEREAS, an application meeting the requirements set forth in ~ 15. 10. 325(B) of the
Seward Zoning Code was submitted and received on May 15, 1995; and
WHEREAS, the request is for development of property located within the Central
Business District; and
WHEREAS, a duly advertised public hearing meeting the requirements set forth in ~
15.01.040 of the Seward Zoning Code was held by the Planning and Zoning Commission on June
7, 1995.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Planning and Zoning Commission has made the following Findings of Fact
based on the applicant's request:
1. The proposed use satisfies the conditions specified in Seward City Code Section
15. 10. 320(D) in that the Seward Association for the Advancement for Marine Science received
a Conditional Use Permit for the construction and operation of the Alaska SeaLife Center on
September 23, 1994.
2. In accordance with the Uniform Building Code, 1991 Edition, the penthouses and the
aviary spire, identified in the Alaska SeaLife Center design plans, were not considered in the
building height variance review.
3. The proposed use is in harmony with the comprehensive plan in that the Seward 2010
Comprehensive Plan recommends that due to the decreasing supply of developable land area

within the city limits, an increase in building height should be considered in select areas of the
community.
4. The minimum height variance necessary to accommodate the extensive infrastructure
required for the Alaska SeaLife Center is 5.6 feet above the maximum building height allowed
by the Seward Zoning Code.
Section 2. Based on those Findings of Fact, the Planning and Zoning Commission hereby
authorizes the City Clerk to issue SAAMS a Variance permit to exceed the maximum building
height limit for the Alaska SeaLife Center on Tract 2A, Seward Waterfront Tracts, subject to the
following conditions:
1. The height requirement is a function of required technical design need rather than
simple architectural desires.
2. The maximum building height, as defined by the Seward Zoning Code and the
Uniform Building Code, 1991 Edition, of the Alaska SeaLife Center will not
exceed 40 feet.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 7th
day of June, 1995.
